Thaïlande: contrat de location d'appartement
Bonjour,
J'étais à Bangkok il y a encore qq jours et j'y ai loué un appartement pour l'année 2010.
La propriétaire n'avait pas de bail à me faire signer, elle m'a simplement envoyé l'email suivant dont je demande s'il a une quelconque valeur légale :
Please be informed and confirm back that you accept the below contract :
Your contract will start from 1st January 2010 till 31st of December 2010
1. if you move out before the end of your contract which is December 2010, you will not get the 2 months deposit back.
2. By the 15th of October 2010 you will inform me that you would like to continue to rent the apartment from January 2011 or move out by the end of the contract.
3. If you have some unpleasant behaviors or habits that the neighbor or the apartment management team complain, I have the right to ask you to move out of the apartment before the end of the contract.
4. the rent will pay before the 5th of each month. ie for April rent, you have to pay before the 5th of April. If you pay late then 500 baht will be deducted from the deposit for the month that you are late paying .. unless there are some circumstances that it can't be help then I understand that totally.We can discuss about it and if we are both agree then there will not be any deduction.
5. You are agree on paying for cleaning before you move out for 800 baht. and if the room is very dirty then you have to pay the full cost for cleaning up.
6. If there are any thing broken during you are staying ... example the floor damage or the hole on the wall... or the scratch on the wall.. then you have to pay for the maintenance before you move out.
7. you will pay all the bills before you move out.
8. I have the right to ask to see the room any time.
9. Please let me know what kind of services you register into the apartment ie, internet connection, Tv cable before or right after you install the signal.
10. If you would like to cook inside the apartment, please be careful with the wall inside the kitchen. If it becomes dirty from the cooking oil then you have to pay for the clean up on that extra from #NO. 5 contract.
11. Please copy your passport and give it to the apartment building office.
12. Enjoy Thailand as much as possible :)

L'adresse de l'appartement n'est même pas mentionnée, le nom des 2 parties non plus...
Ce genre de bail est-il courant entre un(e) proprio thaï(e) et un locataire farang ?
J'ai évidemment répondu au mail pour marquer mon accord mais cela remplace-t-il la signature d'un contrat en bonne et due forme ?
En cas de malhonnêteté d'une des deux parties, à qui profiterait ce contrat approximatif ?
Si la propriétaire est incapable de me proposer un contrat locatif digne de ce nom, est-il possible de passer par un homme de loi qui rédigera un document officiel ?
