Pour être plus claire je vous fais un petit recapitulatif de la situation pour ensuite poser les questions auxquelles j'aimerais que vous m'aidiez a résoudrre !
Je suis francaise, mariée a un gabonais, nous habitons actuellement au Gabon. Nous avons à notre charge la plus jeune soeur (mineure) de mon mari.
Nous comptons rentrer cette année en France et idéalement avec elle.
L'année derniere, nous avons essayé de la faire partir => demande de visa long séjour auprès du consulat de France de Libreville. Ce dernier nous a ete refusé pour la raison suivante : l'interessé n'a pas de parents biologiques sur le territoire francais.
Questions : tout d'abord qu'entendent ils par : parents biologiques ? son frère (de même mère) n'en fait-il pas parti ? que pouvons nous faire pour que le dossier soit accepté cette année ? nous sommes en train de faire un dossier pour que nous ayons l'autorité parentale ? est ce que ca va nous aider ? puisque nous serons avec cela ces representants légaux (j'imagine a ce moment la que si nous partons en France il va de soit qu'elle doit nous suivre ? mais je pense que ce n'est pas aussi simple malheureusement!!!)

cela veut dire ses parents!
je ne suis pas sur qu'ne ayant l'authorité parentale cela puisse suffire pour obtenir un visa d'immigration. L'adoption serait une solution mais je ne sais pas si cela est possible

c'est certain que cela implique des contraintes mais il faut savoir ce que vous voulez. Il suffirait que ses parents donnent leur accord (si la loi permet d'adopter une soeur pour un frere ou mieux vous)

Je vois votre message avec un peu de retard...Les frèreset soeurs ne sont pas des parents biologiques mais des consanguins, nuance ! Par parents biologiques, on entend père et mère ainsi que leurs propres parents. Cela fait du monde mais il est clair que le cas n'est pas le vôtre. L'autorité parentale ne me semble pas être une solution, à moins que votre conjoint n'ait la nationalité française par son mariage avec vous, si vous avez pensé à faire enregistrer l'acte au Consulat Général de France. avec demande d'obtention de la nationalité.
En tout cas, bon courage, la lutte avec l'administration est sans fin !
Pour ce qui est de la nationalité de mon mari il est sur le point de l'avoir cet ete ce qui rendra les demarches cumulée certainement puisque idéalement on aimerait que la petite commence a la rentrée de septembre mais bon on essayera alors avec cette option c'est ce que l'on comptait faire aussi !!
