Je viens de lire cette dépêche extrêmement inquiétante qui risque d'en gêner plus d'un sur ce forum. Moi ça va, ça ne me dérange pas trop car je prends peu les gens en photo, mais je comprends que ça puisse frustrer pas mal de voyageurs.
"PARIS (AP) - Le Tribunal Correctionnel de Bordeaux a condamné vendredi 30 mars à 6 mois de prison ferme et 15.000 euros d'amende un photographe amateur qui avait publié sur son blog personnel plusieurs clichés réalisés lors de ses vacances au Vietnam en 2006. Ces photographies représentaient des scènes de la campagne vietnamienne et notamment des paysans en train de labourer leurs champs ainsi que des enfants jouant au ballon. Le Tribunal Correctionnel a relevé que M. Victor Fariset, l'auteur des photographies et du blog, n'a pas été capable de fournir la preuve que les personnes apparaissant sur ses clichés avaient donné leur consentement pour être pris en photo et apparaître sur l'internet, portant ainsi gravement atteinte à leur vie privée et à leur droit à l'image. M. Victor Fariset a été également condamné à verser 30.000 euros de dommages et intérêts aux parties civiles représentées à l'audience.
Cette condamnation à une peine de prison ferme pour publication de photographies de personnes sans leur consentement est la première en France depuis l'adoption de la Loi sur le Renforcement de la Protection du Droit à l'Image du 26 octobre 2006, prévoyant un maximum de 3 ans de prison et 500.000 euros d'amende pour un tel délit.
M. Nguyen Noc Dinh et sa famille avaient été informés de la présence indue de leur photographie sur ce blog par une ONG vietnamienne qui les a également aidés à saisir les autorités judiciaires françaises. Me. Valérie Frosier représentant les victimes s'est dite pleinement satisfaite de cette condamnation, qui devrait selon elle mettre un coup d'arrêt aux abus photographiques des touristes se croyant tout permis dans les régions pauvres de la planète. L'avocat de M. Fariset s'est en revanche dit choqué par le caractère disproportionné de la condamnation et a indiqué que son client avait l'intention d'interjeter appel."
Il se trouve que le même genre d'histoire s'est produit simultanément en Angleterre, je viens de lire cela. Mrs April FOOL avait photographié et publié des images de pêcheurs.

Hmmm Intéressant comme info. Je me suis toujours posé la questions sur les droits d'images de ces gens. Maintenant au moins cet affaire va mettre un frein -enfin je l'espère- sur les publications abusives par quelques auteurs qui se croient tout permis.

C'est vrai que la poursuite en justice est possible dans l'absolu, au nom du "droit à l'image", (et ça s'applique même à votre petite amie ou votre beau-frère, photographiés en short sur votre blog, s'ils ont envie de vous nuire !) ...mais, dans la pratique, une personne ne vous poursuivra en justice que si elle a un bon espoir de retirer quelque bénéfice financier du procès, autrement dit dans les deux cas les plus fréquents suivants :
1 / Elle juge que la photo porte réellement atteinte à sa vie privée intime ou à sa dignité et peut facilement le démontrer.
2 / Elle a des preuves que la publication de sa photo dans votre blog vous a rapporté de l'argent et espère en profiter un peu à son tour...
Conclusion : Raison de plus pour demander au moins oralement l'autorisation, de ne pas photographier des personnes dans des situations dégradantes et de ne pas publier les photos à titre professionnel ou semi-professionnel dans un but lucratif (concours photo, revues, blog à accès payant, ...)
Encore une fois des principes de base d'éducation...
C'est vrai que la limite entre "atteinte" ou "non atteinte" à la dignité peut être très discutable et que, même en demandant oralement l'autorisation et en éliminant les photos qui ne mettent pas en valeur les personnes que l'on photographie (ce que font en général 99% des photographes bien élevés), le risque n'est pas nul.
D'un autre côté, il y a surement des abus extrêmes (photos "volées" de mendiants par exemple) qu'il faut logiquement sanctionner pour éviter les graves dérives sur Internet... même s'il y a déjà des dérives bien pires que des photos de voyage qui ne sont pas sanctionnées !
Petit avis personnel : La photographie de personnes en voyage, lorsqu'elle est réalisée avec respect et intelligence, peut être un formidable outil de promotion des pays en voie de développement (et un bel outil anti-racisme !). Il ne faudrait donc pas que l'on assiste à une dérive juridique qui réduise les photos de voyage à des photos de monuments ou de paysages impersonnels.
On retrouve ici le même débat qui existe entre le tourisme de masse agressif qui dévaste tout sur son passage et le tourisme discret, qui a envie de faire partager son émotion et de donner envie aux autres de voyager...

Je n'ai pas fait attention à la date d'aujourd'hui et j'ai eu la même réaction que pas mal de gens ici (dont ChristianG)!
Ceci dit le poisson n'est pas si gros que ça, car il est vrai que dans les règles (si je ne me trompe), on est obligés d'avoir un consentement écrit des personnes photographiées avant de les rendre publiques. Dans la pratique, on remarquera que des magazines photos publient très facilement des photos de voyage avec des portraits ou des personnes locales visibles et reconnaissables (sans l'autorisation écrite requise), lorsque celles ci illustrent un voyage lointain et exotique (souvent pauvre!), alors qu'ils ne le font pas pour les portraits pris dans les pays occidentaux!
pour cultiver le riz ils labourent leurs champs 😉 aidés de leurs buffles tout comme nous avec les vaches dans le Maine et Loire (souvenirs de petite enfance)😉
Je trouve tout de même grave ce qui arrive, car la plupart d'entres-nous font des photos, qui peuvent apparaître à un moment ou à un autre sur un blog ou autre forum. Ceci sans aucune arrière pensée. Si les ONG se mettent à agir ainsi maintenant ou allons nous. Ne serais-ce pas plus important pour ces ONG de traquer les photos d'enfants en facheuses postures avec leur pédophile que d'en arriver là avec des personnes qui représentent leur pays, excellent souvenir pour le photographe et quelle joie de les partager avec d'autres personnes intéressées.

Je me suis fait pièger et je suis beau joueur 🤪🤪 mais j'ai quand même quelques excellentes excuses : Quand le premier Avril tombe un dimanche, je suis tellement endormi que je ne m'en rends compte que le lundi 2 ! (la prochaine fois c'est en 2012, je me méfierai !) Je fais partie des gens qui déplorent cette date du premier Avril comme étant la seule dans l'année où on peut rigoler... Le jour où il y aura 365 "premier Avril" par an, le monde se portera surement mieux ! Le thème choisi par l'espiègle Yangguizi faisait de moi une victime idéale car le respect des autochtones en voyage (sur le plan photo mais aussi pour tous les autres manques de respect) est un de mes thèmes favoris sur lequel je pars "au quart de tour"...
Conclusion : Yangguizi est un vrai POISON d'Avril 🙂🙂 A l'année prochaine...

Au-delà de la blague, c'est une problématique à laquelle je suis assez sensible, même s'il m'arrive rarement de photographier des gens, et encore plus rarement de mettre leurs photos en ligne. Mon avatar ne me représente effectivement pas, mais dans ce cas précis, le brave homme qui apparaît sur ce petit cliché est un guide officiel du Musée de la Guerre de Pyongyang, il est donc naturellement destiné à être parfois pris en photo, et comme là bas, tout ce qui peut être pris en photo peut être montré, et que cet homme est photographié dans l'exercice de ses fonctions officielles de représentation en public, on peut gager que l'infraction n'est pas si énorme que ça.
Car oui, publier la photo de gens sans leur consentement est bel et bien une infraction... civile. Il existe bien une base légale à l'octroi de dommages et intérêts, même si dans un cas comme celui-ci, il est peu vraisemblable qu'une telle réparation soit un jour ordonnée... si l'auteur supprime la photo de son blog à la première demande. Pas de peines de prison en revanche pour ce type de "méfait".

En France, le Code Pénal protège aussi le droit à l'image de chacun... par des sanctions pécuniaires (amendes) et de privation de liberté (prison) !!
C'est la hauteur des peines que tu annoncais Yangguizi, qui était choquante (et qui m'a mis la puce à l'oreille quant au poisson d'hier 😉) et l'absence de démonstration d'une volonté de nuire dans cette affaire...
En effet :
l'article 9 du Code Civil protège notre vie privée :
"Chacun a droit au respect de sa vie privée. Les juges peuvent, sans préjudice de la réparation du dommage subi, prescrire toutes mesures, telles que séquestre, saisie et autres, propres à empêcher ou faire cesser une atteinte à l'intimité de la vie privée."
Article qui permet à tout un chacun de demander réparation d'un préjudice subi par la publication de son image sans son autorisation... à condition toutefois de prouver ce préjudice subi.
La condamnation peut alors recouvrir la forme de dommages et intérêts, de saisie des biens incriminés, d'arrêt des faits fautifs, de publication judiciaire dans un organe de presse...
mais il existe aussi l'article 226-1 du Code Pénal, qui prévoit des sanctions pénales en cas de volonté de nuire (à prouver aussi !) :
"Est puni d'un an d'emprisonnement et de 45000 euros d'amende le fait, au moyen d'un procédé quelconque, volontairement de porter atteinte à l'intimité de la vie privée d'autrui :
1º En captant, enregistrant ou transmettant, sans le consentement de leur auteur, des paroles prononcées à titre privé ou confidentiel ;
2º En fixant, enregistrant ou transmettant, sans le consentement de celle-ci, l'image d'une personne se trouvant dans un lieu privé."
Lorsque les actes mentionnés au présent article ont été accomplis au vu et au su des intéressés sans qu'ils s'y soient opposés, alors qu'ils étaient en mesure de le faire, le consentement de ceux-ci est présumé."

Mais j'étais parti du principe que dans le cas de notre ami V.F., la photo ne portait pas atteinte à la vie privée (simples scènes d'extérieur), et ne révélait aucune volonté de nuire. Mais tu as tout à fait raison de remettre les pendules à l'heure.
- A l'époque bénie où les quotidiens régionaux acceptaient de faire paraître des poissons d'avril, je me souviens d'une photo des pompiers d'un patelin posant très officiellement à côté du nouveau véhicule d'intervention rapide qu'ils venaient d'acquérir: une Ferrari, rouge évidemment.
Plus récemment - ah bah voui, c'est donc qu'on y revient après une période de frilosité des rédacteurs en chef - le Chef d'un restaurant renommé indiquait qu'il remettait sur sa carte une très ancienne recette gastronomique alsacienne: le foie gras de cigogne.
Avec des amis, nous avions fait passer une info selon laquelle un vigneron bien connu vendait une grande partie de ses parcelles classées "Grand Cru" à un promoteur immobilier...

d'autant qu'une mauvaise expérience m'a marquée il ya quelques temps déjà: j'ai failli me faire casser la goule à Barbès parceque j'avais soi-disant pris la femme de jenesaisqui en photo (😐??? Il faisait nuit, j'étais en plan large, aprés la remarque je n'ai vu aucune femme dans mon champ de vision)! J'ai dû me carapater en vitesse vue l'embrouille naissante.

I’m a teacher in Creuse, working in a ULIS program (which welcomes children aged 6 to 12 with disabilities into a mainstream school). This year, I’m starting a school journal project that will involve the kids in many different topics. A big part of the journal will focus on opening up to the world, diversity, travel, countries, culture...
I’m launching a call to invite as many of you as possible to send us a little postcard (from France or anywhere in the world!) to take us on a journey and help us discover new places, countries, and horizons—much more fun and exciting than a regular geography textbook! One section of our journal could be called "We received mail from " and would be an opportunity to research that location and share what we learn with our readers (a super enriching activity in class).
The project starts in September 2025 but has no real end date, as this journal and world discovery initiative will span several school years (the kids stay in my ULIS program for multiple years). Postcards can be sent anytime—throughout the year, across seasons, even during holidays! (The kids will find them when they return.)
I hope this idea appeals to as many of you as possible and that you’ll spread the word to your fellow traveler friends. Make us dream, take us on a journey!!!

I just discovered a great show on Arte.
It's called "7 en route": seven young European journalists travel around Europe in a fully converted bus, making reports on every city they visit. It's amazing! 🙂
Yesterday, for example, they were in Rome, Italy, and the reports included things like the world's smallest restaurant—a super romantic spot for two. There was also a report on the king of paparazzi in Italy.
They have to pick topics that let us discover the little quirks of each country. And at the end of each episode, we get to see the finished report.
It's such a great show, mixing journalism, travel, and discovery—basically, a must-watch!

After a quarter without dragging my slippers around here, even though I’d loudly declared I had no interest left in this site, here I am again!
My imagination never stays fallow for long. Just enough time for my inner land to rest. It gets overgrown with fresh nettles, the kind you can pick without getting stung. Then, it’s time to till the fragrant earth and let the story grow.
I hesitated over where to set this story.
Maybe the Highlands, maybe the Hebrides, maybe the Orkney Islands, maybe the Shetland Islands. All of Scotland is myth—easy to embroider.
But in the end, no. I’d almost be too afraid to bare my soul.
The story will take place at home. Simple, practical.

This morning, I was up well before dawn, feeling a bit grumpy, but nothing a bowl of coffee won’t fix. I love my bowl, and no one dares take it. It’s porcelain, edged with intertwined blue flowers. On the bottom, it says "Revol." The factory has existed long before the Revolution. It was my great-grandmother’s bowl. She drank roasted barley from it during the war, then her Leroux chicory.
Last year, a little guy dropped it. My bowl broke into three pieces. A black anger vibrated deep inside me. The little boy was so upset, on the verge of tears. How could I scold him!
I picked up the three pieces and took Little Boy in my arms. His hair smelled of the light, sweet sweat of toddlers. A gentle hug that healed—his budding sorrow and my anger—everything vanished, and time carried on.
Today, my bowl is even prettier. Man fixed it using the traditional kintsugi technique, except he didn’t use gold powder or lacquer but superglue, and he delicately painted the cracks with woad blue. And my bowl is even more beautiful now.
I’m lingering, I can tell—it’s just that a story wraps itself in life, and life can’t be told in the snap of a finger. Life is long. Like in architecture, you start with a rough sketch, called a "sous-cul" (the initial pencil drawing), then you make a tracing, which is the work itself, the one you later carefully roll up in a wooden tube.
Life is like that: you erase, you start over, you use the nub of the pencil until it’s tiny, but you keep going—dreaming, loving.

Nepal, much like Tibet and Bhutan, is deeply connected to the Himalayas—the ultimate sacred mountain range. This small country exudes a calming vibe, shaped by a strong spiritual dimension. What I loved most was the unique sensory experience you get there. Walking around temples and tantric monasteries, a distinct scent fills the air—aromatic plants used for ritual fumigation. Locals mainly burn Himalayan juniper, cedar, sandalwood, and other local essences. This fragrant smoke is a way to purify the space and reach the deities, and you’re constantly enveloped in these aromas.
Another striking aspect is the sound. As soon as you step outside, you hear bells ringing in front of temples. People ring them three times before praying to announce their presence to the deities. Nepal is also the birthplace of singing bowls and sound meditation practices. In Kathmandu, you can easily find meditation sessions or "sound baths."
The spiritual dimension is everywhere: a Hindu sadhu practicing asceticism, a lama in deep red robes with his mala, turning a prayer wheel while murmuring "Om mani padme hum." Newar Buddhism, Tantrism, and Hinduism coexist harmoniously in daily life.

I just installed the Maps.Me app on my phone. I only recently found out about this app. I’m traveling in 2 weeks and a few days, and I’m a bit stuck on how to use it.
I’m from the Montreal (Quebec) area, and I’d love to know if there’s a kind soul out there who could help me get started and use the app at least minimally.
If there are private lessons available, I’d be interested in those too.
Like many others, I’m overjoyed to hear that VoyageForum is reopening! I’ve been waiting hopefully for this, and it’s wonderful that it’s finally happening!
I just couldn’t bring myself to actively participate in other French-language travel forums—their format and way of doing things never appealed to me as much. I really hope that VF’s structure, categories, and interface won’t change too much despite the handover, because I’m very attached to them. Through thick and thin, the site has held strong—it’s amazing!

I’m planning a 3-week trip to Japan in May with Voyage Privé. The package includes a 5 GB eSIM, but my phone isn’t new enough to support it. VP told me I could buy a SIM card when I arrive at the airport.
Sure enough, I’ve seen online that this is possible with different providers.
I only need it for checking routes, looking up addresses, train schedules, etc.—basically using Google Maps, TripAdvisor, and similar apps. No heavy downloads or major internet use. All hotels should provide free Wi-Fi for that, right?
Has anyone got any tips for me on this? What have you tried, and how much did it cost?

I wanted to share a really unpleasant experience from our last trip booked with Promoséjours and organized by FTI.
We booked an 8-day/7-night stay in Egypt, from June 8 to 15.
The flight initially scheduled was changed a week before departure to take off at 10 PM from Paris CDG.
In the end, it took off with a 1-hour delay and included an unmentioned stopover in Marsa Alam.
We landed in Hurghada at 4 AM and arrived at the hotel at 6 AM.
So, we spent our first night on the plane.
For the return trip, surprise—the flight was moved up. We left the hotel at 10:30 PM on Friday the 14th to take off at 2 AM and land at 7 AM at Paris CDG.
So, we spent our last night on the plane too.
After sending a complaint letter to Promoséjours / FTI, they replied that the first and last days can be dedicated to transport (which I already knew) and that no matter how many nights you book, you’re not guaranteed to spend them in the hotel—it could just as well be on the plane.
I’m really questioning this.
Isn’t there a law that protects customers in cases like this?
Because when I do the math, the first and part of the second day were spent on transport, same for the second-to-last and last day. And I paid for 7 nights for a stay that only lasted 5.
Anyway, I just want to say thanks to them—thanks to their two sleepless nights in transit, I’m coming back even more exhausted from a trip that was supposed to be restful!
I also want to warn anyone booking through this agency about visas for Egypt.
At booking, they told me the visa was included in the price, then they sent me an email saying I’d have to pay for it on-site at 25 €.
Once there, we were directed to a special line for FTI customers, and guess what? They charged us 30 €!
Basically, they’re great at making sure you *enjoy* your vacation—mostly by enjoying your wallet!
If anyone has dealt with this kind of situation and won their case, I’m all ears.

So I thought I’d get a Thai SIM card to use Google Maps for getting around cities, mostly.
Here’s my question: will this SIM affect my apps? Or will they work the same as with my Orange SIM?
Is there any setup I need to do, or can I just pop in the Thai SIM?
I’d also like to switch back to my Orange SIM now and then while I’m in Thailand—on the same phone. Will I need to reset the phone, or will it reconnect without any issues?

I’m reaching out to all travelers and globe-trotters on this forum. I’m a teacher in Creuse working in a ULIS program (which welcomes children aged 6 to 12 with disabilities into a mainstream school). This year, I’m launching a school journal project that will involve the kids in many different topics. A big part of this journal will focus on opening up to the world, embracing differences, travel, global cultures, and more.
I’m putting out a call to invite as many of you as possible to send us a postcard (from France or anywhere in the world)! The goal is to help us "travel" and discover new places, countries, and horizons in a way that’s much more fun and exciting than a geography textbook. One section of our journal could be called "We received a letter from ," where we’d research the location and share what we learn with our readers—a really enriching activity for the classroom.
The project starts in September 2025 but doesn’t have a strict end date, since this journal and world-discovery initiative will span several school years (the kids stay in the ULIS program for multiple years). Postcards can be sent anytime—throughout the year, across seasons, even during holidays! The kids will find them when they return.
I hope this idea appeals to as many of you as possible, and that you’ll spread the word to your fellow travelers. Help us dream and explore!

Here’s the thing: during our trip there in April, we discovered a jewelry artisan (highly recommended!) on the left when exiting through the west exit of Nishiki Market (which is a long covered east-west street). I bought a piece of jewelry for my daughter there, but she lost it. I’d love to buy her another one! In the photo, it’s the shop with the yellow awning to the right of the restaurant with the blue awning, "Sushi Sakai."
