Lors d un voyage au Sri lanka, nous avons trouvé un terrain en bord de mer a vendre.
Nous avons bcp de mal a trouver des info quant aux procedures pour l achat de ce terrain.
Quels papiers devons nous demander au proprietaire? Quels sont les noms en anglais des certificats a avoir (titre de propriete, certificat mentionnant que le terrain n est pas gagé, enregistrement au cadastre..).
Comment savoir si le notaire est bien enregistré officiellement?
Pour eviter la taxe de 100/100, le bail de 99 ans (emphyteotique) est il possible et quelles en st les clauses?
Si des personnes ont deja fait l experience d'un achat immobilier au Sri lanka, leurs conseils seront les bienvenus...

Je ne veux pas vous décourager mais il faut savoir que l'achat d'un terrain est sans doute la chose la plus délicate au SL. Des dizaines de personnes peuvent revendiquer un terrain et le problème consiste à savoir qui en est le propriétaire. Souvent celui qui vous l'a proposé n'a aucun droit dessus. Autre cas de figure, le terrain est déjà vendu et vous l'ignorez. Des milliers de commissionnaires sont à l'affut de la bonne occasion et double ou triple le prix pour encaisser la commission. L'ambassade ne vous sera d'aucun secours. Il faut vous procurer le titre de propriété et aller voir un avocat pour lui demander de faire une recherche pour savoir quelle est la situation du terrain. Ils sont très organisés et selon l'endroit ou vous etes il lui faudra une à deux semaines pour verifier dans les archives du district. A partir de là, si le terrain est ok, l'avocat s'engage. Ce sera donc à vous de négocier le prix avec le vrai propriétaire, sachant que les intermédiaires tenteront de le doubler ou lui proposeront un partage sur le prix conclu.
Attention, je ne sais pas ce que vous voulez faire de ce terrain en bord de mer. Mais sachez que pour y construire une maison, vous devrez laisser une bande de 50 m (si mon souvenir est bon) vierge de construction, et ce depuis le tsunami. Renseigner vous à la mairie de la ville la plus proche pour vous le faire confirmer. L'obtention du permis de construire est aussi un enfer. Le racket aux commissions est légion et j'ai vu des Blancs verser des commissions astronomiques pour tenter de faire avancer les choses.Sachez aussi que si le terrain qu'on vous propose est bon marché, c'est qu'il y a un problème à la base.
La taxe pour les étrangers est inévitable sauf de le mettre au nom d'un sri lankais. Mais si vous partez sur cette idée sachez bien qu'en droit sri lankais, le terrain appartiendra au sri lankais et que vous serez impuissant en cas de brouille avec lui. Et croyez moi, si lui n'y pense pas, d'autres autour de lui, y penseront. Le bail à 99 ans n'existe pas selon moi, mais verifiez auprès de l'avocat. En depit de toutes ces galères, certains s'en sortent bien. Ceux là ont tous accepter de payer la taxe pour que le terrain soit à leur noms. Les autres vont de déconvenue en déconvenue et encore je ne vous livre que la version soft.

Nous sommes suisse et les seules propriétaires(mom mari et moi même ) donc aucun problème....Belle maison rénové (catelle, toit sans amiante etc...) ou terrain à coté d'un lagon privée et près de la mer l.Si vous voulez des photos ou plus de détails veullez me contacter ..

After living for many years in the West (Belgium, Italy, Switzerland),
I’ve decided to return and settle in Cameroon, my home country.
Currently an entrepreneur in real estate and transport, I’m looking for a partner / partners / foundation to collaborate on an agriculture project, as I own 10 hectares of land.
