Bonjour, je lance un appel à tout ceux qui pourraient me renseigner sur les démarches d'obtention de papiers pour un sénégalais.. je m'explique:
Mon copain est sénégalais, il vit depuis 5ans en france, il a validé un master(bac + 5), il avait donc chaque année un titre de séjour étudiant d'une durée d'un an.
A l'heure d'aujourd'hui il a fini ses études et souhaite entrer dans la vie professionnelle en France. Le problème est qu'il a passé pleins d'entretiens où à chaque fois c'est le meme discours: l'employeur doit faire des démarches à la préfecture pour qu'il puisse disposer d'un permis de travail ou titre de sejour travailleur je c pas exactement, en tout cas l'employeur doit entamer de longues démarches et payer une certaine somme (je crois), et forcément il préfère embaucher qqn qui est déjà régularisé ou bien un français..
Ma question est la suivante: que peut-il faire pour obtenir ses papiers?
Il a écrit au préfet, mais sans réponse..
On envisage meme de se pacser ou se marier lol, mais à 23 ans on a pas spécialement envie de sengager officiellement déjà, mais je crois que c'est le dernier recours qu'on a trouvé pour qu'il obtienne ses papiers..
Et encore je sais meme pas si les procédures n'ont pas été durcies depuis tous les abus qu'il y a eu..
Bref, il souhaite qu'une chose c'est pouvoir travailler, s'insérer dans la société française comme n'importe quelle personne, mais je comprends pas qu'on puisse mettre des barrières aussi énormes pour des gens qui ont fait des études et qui veulent apporter leur savoir à la société.. alors que d'autres ne parlent meme pas français et réussissent à avoir les papiers??comment font-ils??

Merci pour l'info, oui il est trjs en France, j'ai regardé le lien, mais cette carte "compétences et talents" doit etre demandée 4 mois avant l'expiration de son titre de sejour étudiant et c'est super sélectif, et à l'heure d'aujourd'ui son titre de sejour etudiant a expiré il n'a donc plus de papiers à jour.. c'est trop tard.
Pour ce qui est de la carte salarié, je viens de découvrir qu'il y a une liste de métiers pour permettre d'obtenir cette carte! Et tu vois un peu la liste...
Ca veut dire que par exemple s'il est embauché en tant que vigile il ne pourra meme pas faire sa demande de carte salarié car elle n'entre pas dans les métiers de cette liste?
Enfin, pour ce que tu disais pour le mariage, ca mets 6 ans pour obtenir un papier?
Et s'il fait une demande de naturalisation, crois-tu que c'est compliqué et plein de conditions?

la procedure pour obtenir la nationalité dure autour de 3ans!
a mon avis dans votre situation iln y a pas d'autres choix que le mariage mais je ne pense pas qu'il faut se marier pour qu'il puisse rester en france si tu n'es pas certain encore de votre future

oui c'est ça, vous avez tout ce temps (6 ans) pour réfléchir au mariage, mais pas obligés d'attendre tout ce temps.
Pour que ton ami ne soit pas en situation irrégulière, il faut qu'il aille tout de suite à la préfecture pour demander une autorisation provisoire de séjour de 6 mois, afin de lui permettre de chercher un emploi.

Il sest inscrit à la fac au cas où, pour renouveler son titre de sejour en statut etudiant, il a un RDV à la préfecture en janvier donc je pense pas qu'il soit expulsable à l'heure d'aujourd'hui.
Une fois qu'il aura son titre de sejour etudiant, il pourra faire les démarches de carte compétences et talent ou bien la demande de naturalisation car il correspond aux critères.
Que risque-t-il si sa demande de naturalisation est refusée?
En fait lui tout ce qu'il veut cest pouvoir travailler légalement 35h comme tout le monde, chose qu'il ne peut pas faire à lheure daujourdui avc son titre de sejour etudiant.

S'il n'a pas d'emploi, sa demande de la nationalité sera rejetée.
La seule solution, c'est le permis de séjour provisoire de 6 mois qui va lui permettre de chercher légalement un emploi, ainsi celui qui va le recruter ne sera pas obligé de faire les démarches à sa place auprès de la préfecture.
Et une fois embauché, il dépose sa demande de carte de séjour.
Par la suite, c'est au tour de la demande de la nationalité.

J'ai un ami sénégalais qui est actuellement en Allemagne pour un stage de formation de natation de 4 mois et qui voudrait venir travailler en France à la fin de son visa étudiant. du coup je suis entrain de me renseigner pour les formalités et les démarches à faire et je m'apperçois que rien n'est facile;
j'aimerai donc savoir si tu as trouvé une solution pour ton copain? Car la seule que je vois actuellement c'est de trouver un employeur potentiel qui fasse une demande d'autorisation de travail à la préfecture mais à mon avis très peu voudront rentrer dans ces démarches très lourdes.

Tout d'abord pour répondre à ta question on n'a pas trouvé d'autre solution que le mariage mon copain a réussi à obtenir un renouvellement de son visa étudiant de 9 mois et entre temps on s'est marié! on était pas super emballé mais on n'a pas trouvé d'autre solution, et à l'heure d'ajourd'hui, 2 mois après le mariage toujours pas de nouvelles de la préf sur sa demande de titre de séjour "conjoint de français", croisons les doigts..
Il a pourtant tout essayé il avait même trouvé un employeur prêt à faire les démarches à la préfecture mais le dossier a été rejeté sans raison expliquée.
Pour ton ami à part s'inscrire dans une école afin qu'il puisse résider une année en france et chercher pendant ce temps un employeur prêt à l'embaucher je ne vois pas trop de solution..
Trouver un employeur potentiel pret à faire les démarches sachant que ton ami est en Allemagne est possible mais risque d'être difficile, quelle est sa formation?dans quelle région souhaite-t-il s'installer?
n'oublie pas que la discrimination est plus que présente en france malgré tout ce qu'on peut dire.
Mon mari avec son bac+5 ne trouve que des boulots de sécurité tu vois un peu.
Je ne veux surtout pas vous décourager mais simplement vous informer de la réalité.
