J'ai crée mon entreprise à Pondicherry il y a trois ans, j'ai été obligé de prendre un partenaire indien (49%) depuis que la loi est passée j'ai racheté ces part et suis le seul propriétaire avec mon épouse.

Je suis en train de créer une small company au Kerala. je ne suis pas conseillé par un avocat mais par un chartered accountant (expert comptable). En fait ce sont mes partenaires indiens qui enregistrent la small company en leurnom et j'en prendrai des parts ensuite (jusqu'à 99 % si je veux). Tout cela est en cours donc je ne suis pas certain qu'il n'y aura pas un obstacle imprévu (tel que c'est parti je pense que non, mais je suis comme Saint Thomas). Attention au fait que les lois ne sont peut-être pas les mêmes entre les différents états !
Il est tout à fait exact qu"il faut passer par un chartered accoutant, mais le dossier est soumis à l'accord de New Delhi en tant qu'étranger, et eux ne font aucun obstacle (aujourd'hui) pourquoi pas 100%

Ce n'est pas mon créneaux, mais il y a un élément fondamental à ne pas oublier. Faire des affaires ici: les rentrés financières sont équivalentes au niveau de vie ici, ce ne sont que quelques roupies, pour vivre comme en occident: vous devez dégager au minimum 1/2 lack mensuel de bénéfice net . Vous désirez monter un guest: lisez les posts du forum et vous verrez que tous cherche le guest sympa à 200 Rs la nuit. Faite vos comptes pour engendrer 50000 Rs de bénéfice net mensuel, d'autant que la saison c'est trois à quatre mois.

On peut créer son entreprise avec un visa touriste, on n'as pas besoin d'associés indien, par contre il faut être deux pour une S.A.R.L. Aprés la création il faut se faire un contrat de travail et ensuite demander un visa employment d'un an à l'ambassade, sinon vous prenez le risque de tout perdre en travaillant avec un visa touriste.

Je confirme, oui ! On peut créer une entreprise en Inde sans partenaire indien ! Cela fait plus de dix ans que cette loi a été mise en application.
Aussi, il faut être trés clair à ce sujet, cette loi permet aux étrangers d'investir uniquement dans le secteur du tourisme !
Les procédures sont trés longues et peuvent prendre plusieurs années ! Tout dépend de l'état de l'Inde dans lequel vous voulez investir ? Dans le cas du Kérala, les villages dépendent d'un panchayat, ce qui peut poser problème. Car un grand nombre de ses Panchayats ne connaissent pas ces nouvelles lois et n'hésitent pas à bloquer les procédures.
Pour créer une entreprise, pas besoin d'un avocat, vous pouvez consulter un secretary compagny qui s'occupera pour vous de la procédure. Les attentes administratives sont interminables et peuvent vous faire craquer ! Don't give up !
l'Inde est un pays qui se mérite, c'est pourquoi, il faut être patient !
