je suis un algerien marier avec une francaise, en a tout déposer et le dossier etait parti a nantes .Mais ma femme en france a recu une lettre de nantes en lui disant que moi je vais recevoir une lettre pour que je sois convoquer a l ambassade ici en algerie et pour avoir un genre de entretien et apres cette entretien il vont voir ou bien accepter le dossier de transcription ou non. Et j ai recu la lettre mais j ai etait choquer en voyons la date de rendez vous c'est le 17/02/2007 alors que elle deposer le dossier en septembre a nantes et en es marier ici en algerie depui le 17/07/2006 .Pui je avoir une explication SVP pourquoi ce entretien et pk tout ce temp pour le rdv c'est casiment 6 mois pour que mon dossier de transcription sois accepter esque c'est logique ? merci bcp .
6 mois c'est pas long, quand tu sais que tu vis dans un bled où le temps n'est pas une denrée importante, déjà que ton dossier a été accepté, tu as de quoi etre content.

Il y a deux façons de faire la transcription, soit au consulat, soit à Nantes directement.
La loi française donne aux consulats la possibilité de refuser la transcription de l'acte de mariage sur l'état civil français. Dans ce cas, le dossier est transmis au parquet qui diligente une enquête de police. Cette enquête est faite par la police en France, et sous traitée au consulat en Algérie.
Elle a pour objectif de vérifier que le mariage est basé sur la volonté réelle de fonder un couple, et non pas juste en vue d'obtenir des papiers français, ce qui s'appelle un mariage frauduleux, et est un motif d'annulation (et dans ce cas, c'est comme ça, ta femme et toi n'avez rien à dire).
Quand un dossier de transcription est transmis au consulat, celui ci l'envoie à Nantes, avec éventuellement un avis défavorable à la transcription. Nantes peut aussi décider eux même de refuser la transcription.
Dans ce cas, le délai administratif pour l'enquête est assez long, effectivement 6 mois maximum (car sinon la transcription n'est pas refusable).
Je pense qu'une des raisons de cette enquête, c'est que ta femme a déposé elle même le dossier à Nantes. Ils n'ont donc pas l'avis du consulat transmis par ce dernier, et veulent vérifier ce que le consulat en pense, d'où la demande d'entretien. Amha, ce sera le même type de question que celles qu'ils vous ont posé lors de l'entretien préalable à la délivrance de la capacité à mariage (et j'espère que tu te souviens des réponses et que tu seras cohérent).
A partir de là, deux options :
1- tu es convaincant au consulat, qui transmet un avis favorable à Nantes, normalement ta transcription est acceptée sans autre formalité.
2- tu n'es pas convaincant, le consulat transmet un avis défavorable, transcription refusée. Il vous reste à faire appel devant le juge, durée environ 12 à 18 mois.
Donc en réponse à ta question, oui tout ceci est parfaitement normal.
Je me suis mariée récemment en Algerie au mois de Décembre, je suis allée au consulat afin de faire la transcription de mariage mais ils nous ont dit que Nantes refusera notre mariage car nous n avons pas fait la capacité de mariage. Nous n etions pas au courant. Sais tu quels genres de questions posent ils lors de l entretien? Combien de temps vais je attendre la reponse de Nantes?
nantes ne refusera pas la transcription juste parce que tu n'as pas fait de ccam.
je te l'assure je suis sur un autre forum, et bcp d'entre nous ce sont mariés sans le ccam, et ont obtenu la transcription..
c un peu plus long qu'avec le ccam pour certains mais pour d'autres ça a été très rapide
