Quelles sont les modalités pour la création d'entreprise en RDC car je souhaiterai profiter de cette nouvelle réforme concernant l'amélioration du climat des affaires dans ce pays et donc bénéficier de cette opportunité si elle est vrai?
Je suis natif du pays et pense qu'il est temps de revenir dans mon lieu de naissance.
- Creation d'entreprise en RDC -
Il y a des sites comme l'Anapi www.anapi.org, www.entreprendre.cd
J'ai quand meme l'impression que cette "amélioration du climat des affaires" est un effet d'annonce, assorti de "mesurettes", destiné a compenser l'image pittoyable du tres mauvais classement "Doing Business" de la Banque Mondiale (la RDC est classée au 183 ieme rang sur 184 pays analysés), et "gesticuler" autour de ce dossier, en vue des prochaines elections présidentielles de 2011.
A distance, il n'est pas possible de se rendre compte des non-dits (a cause de la censure sur les sujets dérangeants) et des travestissements (effets d'annonce triomphalistes mais rares concrétisations). Donc, si tu as gardé des liens avec la RDC, renseignes-toi bien sur ce que pense la population, et envisages un voyage d'évaluation; tu te rendras vite compte de l'ambiance, au travers de l'attitude des fonctionnaires (dès l'aéroport), des agents de roulage sur la route, du prix des denrées alimentaires, du nombre d'entreprises... Si tu n'as pas de passeport de RDC, il faut aussi penser au budget immigration, puisque qu'il n'y a pas de double nationalité possible avec la RDC.
Je pense donc qu'il n'est pas prudent de créer une entreprise en RDC actuellement, sauf si tu as de serieux appuis dans la classe dirigeante, ou une activité délocalisée (télé-travail), ou un contrat avec une grosse entreprise/ONG. Sinon, il y a un risque important de subir les tracasseries de l'administration, jusqu'au harcelement, surtout si les fonctionnaires ne sont toujours pas payés régulierement : l'Etat de RDC n'arrive pas a payer les 30 ou 50$ mensuels des fonctionnaires.
De mon point de vue, c'est significatif d'un gouvernement laxiste, qui n'est pas capable de protéger les investisseurs contre la corruption, en partie parce qu'il n'a aucun argument pour démontrer sa propre intégrité.
Je suis ravi de recevoir votre réponse concernant la création d'entreprise en rdc ET étonné de conctater que la même réponse revient souvent sur l'etat économique du pays car il y a la partie des news que l'on reçoit via internet et la réalité qui est d'aprés vos dire totalement décalé de ce qui se passe au pays mais bon je me dis que si les libanais et autres etrangers arrivent a tirer leur épingle du jeu et ben je pux le faire aussi même si le noir regarde son frère noir comme un concurrent potentiel qu'il ne faut pas laisser atteindre la réussite et par contre l'étranger lui peut s'enrichir tant qu'il me paier des pots de vin.

Je désire moi aussi créer mon entreprise à kinshasa. D'après mes renseignements faire construire une maison à kin n'est pas un réel problème, le réel problème est de trouver de la main d'oeuvre qualifier, dans les domaines électricités et sanitairtes. d'après vous mes sources, sont elle correct? Trouve t'on du matériel de qualité, ou vaut-il mieu l'importé? Il y a t'il réellement du potentiel dans la construction n'est-il pas trop compliqué de se faire payer? Trouver du personnel local avec une formation de base dans ces métiers est-il possible? J'ai d'autre question, merci de prendre le temps de me répondre. Un premier voyage de prise de contact est prévu au mois de février.
Dans l'immobilier, ce qui pose le premier probleme est l'achat de la parcelle; c'est en amont de ta question, mais peut éclairer d'autres lecteurs du forum. Il y a un risque important d'escroquerie; par exemple un escroc qui se fait passer pour le proprietaire. Aussi l'usage veut que tout soit payé en cash (pour échapper au fisc, aucun recours ultérieur)... Les congolais sont eux-meme victimes, meme les politiciens utilisent des astuces juridiques pour spolier leurs adversaires politiques. Et l'Etat n'est pas encore en mesure d'assurer son role de garant (malgré les hologrammes sur les titres de propriété).
Concernant la réalisation des logements, le secteur n'est pas structuré, il y a des bons et des mauvais. Je ne parlerai pas des multiples "abris" en parpaing-tole ondulée qui pullulent a Kinshasa. Dans des batiments prestigieux, on voit ainsi de grosses erreurs d'architecture: une marche ou une colonne placée en dépit du bon sens, incohérence dans le choix et la géometrie des fenetres, non respect des règles de sécurité, hideux disjoncteurs de climatisation qu'il faut sans cesse renclencher en cas de coupure de courant...
L'idée force de l'architecture congolaise est le tape-a-l'oeil (le "paraitre"), la fonctionnalité passant au second plan. Le paraitre est une composante importante de la culture congolaise, que l'on retrouve dans le gout du prestige (voiture, mode, téléphonie), malgré une misere de vie quotidienne (cuisine au braséro, logement précaire ou insalubre, manque d'eau et d'électricité).
Concernant les matériaux et les techniques, c'est la meme chose: du bon et du mauvais. Le choix pour les matériaux a bas prix (principalement chinois), conduit a des réalisations éphémères, dont la durée de vie est encore plus écourtée par l'absence d'entretien (encore une composante culturelle typique).
Les ouvriers sont souvent choisis parce qu'ils sont des cousins du contre-maitre, alors qu'ils sont le plus souvent chauffeurs de taxi, ou vendeur d'unités téléphoniques.
En conclusion, il est nécessaire de tout controler, et de se donner la peine de chercher les bons matériaux, et les bons ouvriers. Si tu veux monter une entreprise de construction il faudra nécessairement envisager de former - et fidéliser - tes salariés (fideliser = bien payer); pour les materiaux, il y a énormément de ressources naturelles locales qui restent inexploitées car pas assez prestigieuses aux yeux congolais (pierres de taille, bambous...). Dommage que la culture congolaise ne soit pas mise en valeur dans l'architecture.
Le potentiel dans la construction réside dans l'appartenance a un groupe humain (ethnie, cercle familial, nationalité - la qualification passe au second plan), et dans l'offre d'un bon prix (le pouvoir d'achat est faible). Si tu n'appartient pas à un groupe, il n'y a que de très faibles chances de décrocher des contrats de la part des membres de ce groupe.
Il reste les investisseurs neutres (ONU, ong, UNICEF...) qui procèdent par appels d'offres.
Exemple d'investisseurs étrangers : les libanais ont fait construire par des libanais le siege de Ecobank, Rakeen du moyen-orient fait construire par ses propres contre-maitres l'hotel de la place de la gare... Pas facile de se faire un nom lorsqu'on n'appartient pas a l'un de ces groupes humains. Et pour les étrangers, des vautours guettent et n'hésiteront pas a décourager l'entrepreneur qui émerge et gagne de l'argent (ticket d'entrée exorbitant a payer au notable du coin, intimidation, coup-montés rocambolesques, pillage téléguidé... - pourquoi donc les entreprises du Congo ont elles disparu et pourquoi n'y a il plus de créations alors qu'il y a tant de besoins élémentaire insatisfaits ?)
Se rappeler aussi, que, dans le tout dernier classement de développement humain, la RDC est avant-derniere, moins bien qu'au temps de Mobutu!!! Sans parler du climat des affaires, ou la encore la RDC se classe derniere mondiale. Ces maigres résultats a la veille des élections, attisent les oppositions au régime. De ce fait, le régime est toujours aussi instable et incapable de protéger les investisseurs nationaux comme étrangers. Prudence donc, avoir une idée et vouloir la developper n'est que 1% des difficultés a venir.
