Je suis actuellement au Brésil en séjour touristique; mon visa normal de 3 mois expire en juillet et si je le prolonge à la Police Fédérale pour 90 jours de plus, ça me mène à début septembre (compte tenu de 2 séjours touristiques que j'ai effectués auparavant et qui sont décomptés par la Police Fédérale).
Ma question est la suivante : une entreprise française installée au Brésil veut me faire passer des entretiens pour travailler sur place fin août (pas possible avant), ce qui signifie que le processus de recrutement ne sera probablement pas fini début septembre, date d'expiration de mon visa de 180j au total (90+90) : que se passe-t-il si je reste quelques jours ou quelques semaines de plus pour terminer le processus de recrutement ?
Si le recrutement ne se fait finalement pas et que je doive rentrer en France, j'ai entendu parler d'une amende ? combien ? à payer à la sortie ?

Des que la procédure de Visa de travail est en cours, tu as le droit de rester sur le territoire. La règle du Visa touriste de max 6 mois par an tombe. Il faut que l'employeur justifie qu'il ne peut trouver une personne avec ta formation sur le marché de l'emploi local.

Il y a 9 mois, c'était 8 R$ par jour de dépassement. Si tu dis au douanier que son apys est si beau que tu ne pouvais pas te résoudre à le quitter. Une amie l'a fait pour un dépassement de 3 mois et le douanier a été compréhensif...

Il vous faudra une lettre de l entreprise Française indiquant une entrevue en aout, essayez de negocier votre presence au Bresil jusque a cette periode et ceci a la police federale de sao paulo, si la police vous dit non, en restant vous serez sujet a amende etc etc .
De toute maniere pour le recrutement il faudra l attendre en France car il y a tout un trajet bureaucratique pour avoir un visa de travail avec contrat etc etc
VELAXASEGA, tes réponses ne sont pas correctes et demande rectification de ma part :
1° Un touriste vient au Bresil pour une durée de 3 mois sans visa, dans ces 3 mois, il peut faire des sorties/entrée de territoire bresilien, les douaniers comptabilisant à la louche le nombre de jour passé sur le territoire bresilien, en verifiant les tampons d'entrée et de sortie. En resumé un touriste peut venir 1 mois en janvier revenir 1 mois en Juin et en solde sur l'année en cours il lui restera 1 mois....
2° ensuite avant l'echeance de ces 3 mois, le touriste peut demander un visa de tourisme de 90 jours, qui peut être refusé ou donner pour une periode plus courte, c'est le policier de la PF qui décide et donc les 90 jours ne sont pas forcement une réalité, d'ou l'intêret de le demander au moins une semaine avant le depart prévu, pour avoir le temps ensuite de modifier sa date de retour au niveau de la compagnie aérienne. Le visa de 90 jours ou moins partant du jour de la demande, autorise aussi des entrées/sorties de territoire multiples, mais par contre, aura une date d'echeance determiné par sa date d'emission, et non modifiable.
3° pendant le séjour sur place, un touriste peut effectivement se faire recruter (ne veut pas dire travailler) par une entreprise, si le candidat convient à l'entreprise, par contre il ne pourra rester au Brésil, sous le motif qu'une demande de visa de travail est en cours. Son statut même pendant la demandeémise aupres du ministere du travail et de l'immigation à Brasilia, déposé par l'entreprise recruteuse, sera celui de simple touriste 😮. Il devra donc faire attention à être en regle vis à vis de ses conditions de son séjour.
Ensuite, dans le cas ou le visa de travail etait accordé, le titulaire ne pourra pas travailler tout de suite dans l'entreprise, s'il est au Bresil de maniere légale (statut de touriste). Le titulaire devra aller le recupérer aupres de l'ambassade du Bresil implanté dans son pays d'origine et ensuite revenir dans les 90 jours pour le faire valider et seulement apres il pourra integrer son nouvel emploi
4° Depuis moins d'un an, les contrôles en frontiere sont plus ferme, et tous les touristes qui dépassent le temps alloué, se voient maintenant infliger une "multa" payable avant embarquement dans l'avion. Celle ci est de 336 Irfs soit + ou - 320, 00 reals pour un depassement de 0 à 30 jours et ensuite 8 reals par jours, avec un maxi d'amende de 820, 00 reals ( 320 euros).
Donc Velaxasega, désolé tu es vraiement loin de la vérité....

Bon, si j'ai bien compris, il me faut être assez organisé fin août si le recrutement est toujours d'actualité; j'essaierai d'obtenir cette lettre de la part de l'entreprise française mais cela m'étonnerait que cela conduise la PF à prolonger encore plus mon séjour touristiques qui arrivera début septembre à 180j.
2 petites questions en retour :
j'ai lu qu'un protocole provisoire émis avant l'obtention du visa de travail permettait de rester ici et de commencer à travailler en attendant d'aller récupérer le Visa de travail dans son pays d'origine ? apparemment, il n'existe plus et il faut coûte que coûte quitter le pays ce qui signifie impossibilité de commencer à travailler avant 30/45j, le temps que le visa de travail soit établi ? vous avez davantage d'infos ?
si en définitive l'entreprise décide de me recruter mais que le processus complet de recrutement fasse que j'ai déjà dépassé mon visa de touriste, cela risque-t-il de rendre plus difficile l'obtention du visa de travail de la part des autorités brésiliennes (qui me feront de toutes façons payer une amende à l'aéroport, si le cas devait se présenter)

je viens de me tuyauter sur le sujet qui t'interresse,
et je te confirme qu'il n'y a pas de protocole provisoire de délivré 🤪 . Un protocole est un papier administratif délivré par la Police Federale, qui confirme que tu as déjà en main ton visa !!! 😮 dans l'attente de l'etablissement de ta carte définitive plastifié, car aujourd'hui il faut plus ou moins 16 mois pour la recevoir de Brasilia. Donc ce bout de papier a valeur de document officiel et te permets de bosser...
Une fois l'autorisation de visa accordé à l'entreprise, celle ci te le fera savoir, et tu devra donc aller poser ton passeport à l'ambassade du Bresil à Paris pour recevoir, le tampon adéquate et ensuite tu aura 90 jours pour te rendre au Bresil, et dés ton arrivée, tu aura 30 jours pour le faire valider aupres de la PF ( qui te donnera un protocole), si tu ne le fait il sera perdu pour toi et l'entreprise.
Visa Temporaire V Expatriés (RN64/05) - Membre d’équipage d’embarcations maritimes (RN72/06) - Technicien ou professionnel avec contrat de travail oustage pour les entreprises ou pour le Gouvernement brésilien (RN37/99 – RN61/04 – RN57/03).
Le Visa Temporaire V, après autorisation de la « Coordenação Geral de Imigração », et du Ministère des Relations Extérieures au Brésil et 6e reçu par le Consulat Général à Paris, sera délivré à l’intéressé, moyennant la présentation de la documentation suivante :
· Passeport avec délai de validité supérieur à 6 (six) mois;
· 2 (deux) formulaires de demande de visa dûment remplis et signés par l’intéressé;
· 2 (deux) photos récentes, 3x4, (format identité), de face et sur fond clair ;
· Extrait du Casier Judiciaire récent de 3 (trois) mois, pour les séjours supérieurs à 90 jours;
· 100 euros par mandat-compte.
* * Dans le cas où l’intéressé sera accompagné de son épouse et de ses enfants, il faudra présenter toute la documentation ci-dessus pour ses dépendants.
Il est nécessaire consulter consulat@bresil.org pour vérifier si l’autorisation est arrivée
ensuite si tu te prends une amende pour dépassement de temps de séjour, cela ne viendra pas penaliser ta demande en cours.....
