Voilà mes questionnements !! Je suis en train de vérifier le document pour les procédures en ce qui à trait à l'immigration d'un cubain.
Mon copain a fait son service militaire et pendant son service il a fait une niaiserie comme tout adolescent.
Il était avec 2 amis et ils ont pris un véhicule militaire et ils sont allés à l'exérieur de la base donc, dans les rues. Puis, ils se sont fait pincer et suite à cette mésaventure il a fait un an de prison et il a un dossier. Ça va faire maintenant 4 ans de cette mésaventure et il demande maintenant son pardon. Alors mes questions sont : Est-ce que son dossier sera complètement effacé suite au pardon et est-ce que son temps de prison sera effacé ou bien il sera toujours dans les dossiers ?
Puis pour le formulaire d'antécédents pénaux quand il aura son pardon et que son dossier sera effacé...est-ce qu'il devra quand même inscrire qu'il a déjà commis une infraction ??

Je ne sais pas si suite à son pardon à Cuba, tout sera effacé des dossiers là bas. Ton mari est le mieux placé pour aller se renseigner aux autorités de sa ville à ce sujet.
Ce que je te suggère, c'est d'attendre qu'il ait son pardon. Ensuite qu'il demande un certificat d'antécédent pénal pour voir si cela apparaît. S'il n'y a rien d'inscrit, alors tu pourras débuter les procédures d'immigration. Mais si cela appaît sur son certificat d'antécédent pénal, alors oublie ça.
Dans les formulaires d'immigration, il devra le déclarer. Il y a une question où il doit répondre s'il a déjà été en prison. Et il y a une autre question où il doit dire s'il a déjà été reconnu coupable d'une infraction criminelle. Il y a également une case pour expliquer de quoi il s'agit, il pourra donc dire qu'il a reçu le pardon. Je ne te conseille pas de mentir sur ces questions, car son visa sera automatiquement refusé. Tu devrais téléphoner à Immigration Canada pour savoir si le fait de répondre oui à ces deux questions va l'empêcher d'avoir son visa.

En théorie, oui un cubain peut immigrer au Québec sans être marié (voir les catégories donnés par Nikky). Mais en pratique c'est assez rare.
C'est impossible pour eux d'entrer dans la catégories d'investisseurs car ils sont trop pauvres. Comme travailleurs qualifiés j'imagine que c'est très rare puisqu'ils doivent avoir l'argent pour payer l'immigration (impossible ou presque) et doivent parler très bien le français. À moins d'être recruté directement par une compagnie, qui elle doit prouver qu'il n'y a aucune personne au Québec qui peut faire le travail. Pour le statut de réfugiés, je ne pense pas que ça soit accepté si le cubain fait sa demande à Cuba à l'Ambassade du Canada à la Havane. Mais je peux me tromper là dessus. La pluspart arrive par le regroupement familial. Ça ne veut pas nécessairement dire être mairé avec une québécoise, ils peuvent avoir déjà de la famille cubaine ici.

Je retourne le voir en juin et je resterai avec lui un mois.
Si tout va bien je pense bien retourner le voir cet automne et on prendra la décision par la suite de se marier ou non.
Je voulais simplement en savoir plus long sur le dossier pénal.
Mais tu dois absolument te marier avec un cubain si tu veux qu'il immigre ici.

Juste une précision: demander le statut de réfugié ne veut pas dire que l'on sera accepté. Les délais sont très longs (plusieurs mois, voir plus) et si la décision est négative, la personne doit retourner dans son pays.
Par contre, il est possible de faire la demande de statut de réfugié à Cuba, auprès du consulat.
Dans le cas ici présenté, la meilleure option est selon moi le regroupement familial.

C'est certain que le statut de réfugié n'est pas automatiquement accordé. On entend quelques fois dans les médias des histoires de ce genre, où des gens doivent quitter le pays après y avoir habités plusieurs années. Les cubains que je connais dont le statut de réfugiés leur a été accordés ont attendu 2 ans pour l'avoir. Et après ils doivent faire une demande de résidence permanente.
Je savais pas qu'il était possible de le faire à partir de Cuba. Probablement que très peu de cubains le savent sinon ils seraient des millions à faire ça.
