Ma copine a décrochée un travail à New York pour 18 mois (elle commence en Mars 2015) et du coup je pense la rejoindre la-bas. je sais qu'il y a déjà des posts sur la question cependant je n'arrive pas à me décider sur les points suivants:
si je fais des aller-retours, 90 jours la-bas puis 1 mois en France puis re-90 jours la-bas puis retour en france 1 mois etc... ca me ferait environ 5 aller-retours sur 18 mois. Est-ce une option a risque??
sinon, si je fait la demande d'un visa B2:
1) et que celui-ci est refusé. puis-je encore prétendre a l'exemption de visa de 90 jours??
2) celui-ci est accepté. après les 6 mois, je fais une demande de prolongation, elle est refusée, je serais bloqué pour le reste de l'année? ou je pourrais tjrs prétendre aux 90 jours?
3) si la demande de prolongation est acceptée, cela veut dire que j'ai le droit à 1 an + 6mois l'année d'après?
donc 18mois? et quel est mon % de chance d'obtenir une prolongation alors que ma seul raison d'être la-bas, bah c'est ma copine...
pour ceux qui se demande ce que je compte faire pendant 18 mois sans travailler, je pense écrire un scénario pour un film...

Les USA ne veulent pas qu'un alien vive tres longtemps chez eux :
Il y a donc 2 systèmes :
un simplifié l'ESTA, qui permet de rester 90 jours en 1 fois, ce qui correspond à la très très grande majorité des voyages touristiques ou d'affaire, et un autre , le visa, qui permet de rester 6 mois, éventuellement renouvelables, mais qui est accordé apres un examen plus approfondi, pour vérifier notamment si il n'y a pas volonté de s'installer et/ou travailler.
Il est bien évident que si vs profitez de l'un ou l'autre système pour vivre plus longtemps là-bas, vs violez la legislation,
ceci est surtout valable pour l'esta, et bien qu'il ne semble pas y avoir de regles ecrites, je pense qu'on ne tolererait pas un retour pour 90 jours apres 1 mois en France, ou alors ca marcherait une fois.
De plus courts séjours, plus fréquents semblent mieux passer.
Pur le B2, il faut des attaches en France, le plus important semblant être un emploi ; un appartement n'est pas pertinent, car ca se reloue...Il y a pas mal de discussions sur le refus d'un B2 sur ce forum.
Il faut aussi une raison valable de rester plus longtemps que 3 mois : pourquoi un touriste veut il rester 6 mois aux USA.
Enfin, le refus d'un B2 annule votre ESTA, et vs empeche d'en redemander un pendant 5 ans.
Pour l'obtention du Visa B2 il faut présenter un dossier en béton et justifier de solides attaches en France. Sur le site de l'Ambassade des Etats Unis, il est précisé :
“Attaches” se dit des différents aspects de la vie qui lient une personne à son pays de résidence: ses biens, son emploi, ses relations sociales et familiales.

Fais une petite recherche sur le forum, il y a eu dernièrement plusieurs discussions de personnes qui se sont vu refusé le visa B2 ou l'entrée aux Etats Unis.
En cas de refus, tu ne peux plus bénéficier du programme d'exemption de visa (ESTA).
Il te faudra un visa même pour une escale de quelques heures aux Etats Unis.
L'ESTA ne te garantit pas l'entrée aux USA. C'est l'agent d'immigration qui décide si tu peux bénéficier du programme d'exemption ou non.
Ton ESTA du mois d'octobre ne sera plus valable si ton visa est refusé ou si tu te fais refouler au passage de l'immigration.
Faire 5 AR, ça ne marchera pas. Une Française a essayé de remettre le compteur à zéro en passant par le Mexique. Elle a passé 2 mois en centre de rétention au Texas.....

Ta copine aura un visa, et il est possible de demander un visa B2 expressément pour l'accompagner:
U.S. visa law does not recognize common-law relationships; therefore a partner or fiancée is not eligible to apply for derivative visa status. In such cases, the partner is required to qualify for a visa in his or her own right. Partners who are members of the household of the principal visa holder and whose primary purpose in traveling to the United States is to accompany that person, may apply for a B-2 visa. Partners who intend working or studying require the appropriate work or student visa.

Évidemment, cela ne te donnera pas le droit de travailler, mais tu dis avoir de bonnes économies, ça devrait suffire pour la demande de visa. À mon avis, tu te qualifies pleinement pour le visa B2! 😉
Présentes-toi à l'ambassade en même temps que ta copine, et demande un visa B2 pour que tu puisses l'accompagner. Selon le site de l'ambassade américaine, c'est tout à fait possible.
Justement le fait d'avoir une copine qui vient travailler sous un visa est, contrairement à ce que l'on te dit ici, un point en ta faveur.🙂
