J'ai une question de la part d'une amie à moi. Voilà sa situation est très compliquée. Elle est algérienne et est partie faire ses études au Québec en 2007. Mais elle s'est arrêtée la dernière année de licence (donc en 2010) à cause de sérieux problèmes de santé. Bon très sincèrement sa situation était vraiment difficile mais elle s'y ait vraiment mal prise évidemment. Donc elle n'a pas complètement finit sa licence. Elle travaille actuellement au Canada mais sans permis de travail ni d'étudiant (celui-ci ayant expiré il y a longtemps maintenant). Elle ne s'est pas faite prendre mais elle souhaite quitter le Canada volontairement puisqu'elle ne peut pas se faire régulariser et finir sa licence la-bas.
Lui serait-il possible de recommencer ses études depuis le début, en France en demandant un visa d'étudiant? Ou est-ce-que son passé en terme d'immigration signifie qu'elle va se heurter a un refus? En gros, niveau législations est-ce-que la France accepte des personnes qui ont travaillé au noir dans un AUTRE pays, ou est-ce-que c'est mort?
Ben si elle travaille au noir (vraiment très très risqué car elle risque l'emprisonnement quand même) techniquement ce n'est mentionné nul part et elle ne doit pas recevoir de salaire officiel. Maintenant quand elle va quitter le Canada, elle va montrer son passeport et là ça peut être compliqué car elle ne s'est pas faite prendre mais en quittant le pays ça risque d'arriver. Si elle s'en sort indemne il n'y aura rien de mentionné donc elle n'aura pas de souci vis à vis de la France. Par contre si elle se fait prendre en quittant le pays elle peut avoir de très sérieux ennuis et là ça va dépendre des décisions de justices canadiennes. Normalement ça ne l'empêchera pas de déposer une demande de permis en France mais clairement ça ne jouera pas en sa faveur.
Peut être qu'un ou une algérien(ne) pourra confirmer les points demandés dans une demande de permis en France, mais clairement ce n'est pas ce qui m'inquièterait le plus. Si elle a passé 5 ans à bosser au noir elle risque des ennuis bien plus gros que savoir si elle pourra venir en France.
Mais normalement chaque pays a sa politique d'immigration propre.

En fait, ce que j'ai cru comprendre c'est que ce n'est qu'à l’entrée au Canada qu'ils coincent les gens, mais si elle ne veut que quitter le pays ça m'étonnerait qu'on l'en empêche. Elle ne risque pas de pouvoir retourner au Canada très facilement de toute façon. Bien sur il y a le risque qu'elle se fasse prendre à travailler au noir avant de partir, et là oui je pense que ça risque pas d’être drôle.
En fait je pensais plutôt au fait qu'en France pour une demande de visa d’étudiant, je pense qu'on lui demandera d'expliquer ou elle a passait ces dernières années, et une preuve de visa du Canada (auquel cas ils verront qu'elle n’était pas autorisée à rester la-bas aussi longtemps en effet). Et dans ce cas, est-ce-qu'ils laisseraient passer ou est-ce-qu'ils ne voudront pas de quelqu'un qui a vécu illégalement dans un autre pays auparavant...
ben clairement, quand tu demande un visa étudiant où tu n'as pas le droit de rester après et que par le passé tu as violé les lois et pas qu'un peu dans une situation similaire, ça va franchement pas pencher en sa faveur. On ne sait jamais mais ça risque fortement de ne pas plaire à l'immigration française.

After living for many years in the West (Belgium, Italy, Switzerland),
I’ve decided to return and settle in Cameroon, my home country.
