soit vous avec un contrat signé des 2 partie (entreprise et vous) avant de partir soit surtout NE SIGNEZ PAS VOTRE CONTRAT EN ARRIVANT !
il existe en effet un petit article dans le code du travail de mayotte qui vous servira bien : En effet sans contrat ECRIT et signé par les 2 parties vous pouvez rompre le contrat SANS PREAVIS pendant les 60 premiers jours et le billet retour sera à la charge de votre entreprise !
Art. L. 121-6. - Tout contrat de travail passé avec un salarié qui ne réside pas à Mayotte au moment de la proposition d’emploi doit être écrit. Il doit obligatoirement préciser : 1° La durée minimale du contrat en cas de contrat à durée indéterminée et les mentions visées à l’article L . 122-4 en cas de contrat à durée déterminée ; 2° La qualification et les fonctions prévues ; 3° La convention collective applicable de plein droit, ou par accord entre les parties ; 4° Le salaire et les primes éventuelles, frais de voyages et de transport ainsi que celles relatives aux éventuels voyages périodiques ou au rapatriement intervenant à l’échéance prévue ou antérieurement à celle-ci. A défaut de contrat écrit préalable à son engagement ou consécutif à sa prise de travail, le salarié est en droit de mettre fin à sa relation de travail sans justification et sans délai de préavis ni indemnité dans les soixante jours de son arrivée à Mayotte. Il peut alors prétendre à la prise en charge de son rapatriement par l’employeur, à la date de son choix, dans les trente jours suivant la notification de sa décision et aux dommages intérêts éventuels, que le contrat ait ou non reçu un début d’exécution. Ce rapatriement s’effectue par la voie la plus rapide. Il peut être fait exception aux dispositions du présent article pour les travailleurs en mission à Mayotte pour une durée n’excédant pas trois mois.

Cela fait déjà quelques mois que je me renseigne sur la vie à Mayotte et mes candidatures spontanées sont restées sans réponse!! dur dur de postuler depuis la métropole car les patrons préfèrent voir les personnes pour un éventuel entretien, ce que je conçois tout à fait. De plus n'étant pas fonctionnaire je recherche un job dans la comptabilité ou dans un autre domaine d'activité car très motivée et dynamique malgré mon grand âge (46 ans) !!!
N'importe quel taff ferai mon bonheur mais la question essentielle est : y a t-il réellement du travail pour les métropolitains ???
Et vous que faites vous comme job et êtes vous déjà sur le territoire Mahorais ??

je viens de lire votre message concernant les contrats de travail à Mayotte, et on me propose un contrat appliquant une partie de salaire comprenant "indemnité logement versée sous forme de prime d’expatriation " connaissez vous cela ' et ce que c'est valable même en cas d'achat ? et avec la nouvelle departementalisation?
Et d'autres part concernant le code du travail en vigueur a mayotte, pouvez vous m'en dire les pièges ?

A ma connaissance, il n'existe pas de texte à Mayotte sur l'indemnité logement. Par contre, selon l'article 81 du CGI de Mayotte :
"Sont affranchis de l'impôt (sur le Revenu) :
21°b - Le supplément de salaire résultant d'une indexation et les indemnités liées à l'éloignement, versés aux autres salariés (non fonctionnaires) titulaires d'un contrat d'expatriation, dans la limite de 30% du salaire de base.
La qualité d'expatrié se perd à la date du 4ème anniversaire de la signature du contrat initial."
Bravo ! Vous avez donc gagné 30% de votre salaire en non imposable. Cet avantage n'est pas appliqué par toutes les sociétés (notamment pas par la mienne) et je ne saurais donc que conseiller à tous les métros qui se voient proposer un contrat à Mayotte de réclamer cette part d'expatriation.
Par contre, je n'ai pas la même lecture que Fabienne concernant l'article du code du travail de Mayotte : si l'employeur vous propose un contrat, même à l'arrivée à Mayotte, refuser de le signer équivaut à refuser l'emploi et l'employeur n'a donc plus aucune obligation envers vous. Trop facile de venir en vacances à Mayotte en se faisant payer le billet par une entreprise sans intention d'y travailler.
Je pense que cet article vise plutôt à sanctionner des employeurs qui vous feraient venir à Mayotte sans vous proposer de contrat de travail et vous occuperait donc dans un emploi clandestin.
Pour ce qui est des cotisations et prestations sociales, j'ai déjà eu l'occasion d'y répondre : cotisations Sécurité sociale et vieillesse sur un plafond de 912 €, donc prestations calculées sur ce plafond. Idem pour le chômage avec un plafond de 1000 €. Rien de prévu en retraite cadre.
Donc à vous de négocier avec votre employeur ou de cotiser à titre personnel.

une autre d'ordre pratique, vaut-il mieux emporter un maximum de chose de la métropole au déménagement ( voir même voiture ) ou déménager "leger" et acheter sur place.
Pour ce qui est de la prise en charge du déménagement et du transport, il n'y a pas de règle, tout dépend de l'entreprise et de votre poste : A vous de négocier.
Voyager léger ou déménager ? C'est selon votre vision de la vie à Mayotte : y transposer votre univers familier ou chercher autre chose.
Personnellement, j''en suis à mon deuxième séjour et j'ai à chaque fois racheté tout le nécessaire sur place.
Par contre, je me suis arrangé jusqu'à présent pour avoir des voitures société : vu l'état des routes, elles ne durent pas bien longtemps en bon état.
Quoi qu'il en soit si vous voulez ramener la vôtre, assurez-vous qu'il s'agit d'une marque représentée à Mayotte, sinon galère au moindre pépin.
Inutile aussi de ramener Porshe, Audi TT ou autre moto 1300 cc (et pourtant ça existe à Mayotte) : la vitesse est limitée à 70 km/h sur toute l'ile et gendarmes et policiers ont reçu récemment des radars lasers.
Autre conseil : entrainez-vous en métropole à respecter les limitations de vitesse en ville, ça vous évitera de vous énerver derrière les mahorais qui roulent à 50 à l'heure sur nationale (30 km/h la nuit).

D'une manière général les comptables trouvent du travail sur l'ile, mais hors structure type grosse entreprise c'ets le bouche à oreille qui marche le mieux

supérieur d'appel de Mamoudzou, 2 décembre 2003) de l'avoir condamnée
à payer à Mme X... une somme au titre des frais de rapatriement et de
déménagement alors, selon le moyen, que seul le salarié qui est
rapatrié à l'échéance ou antérieurement à l'échéance prévue par le
contrat de travail est en droit de bénéficier d'une indemnité au titre
des frais de transport et de voyage qu'il a dû exposer ; qu'en
conséquence, le salarié engagé pour une durée indéterminée ne peut
bénéficier d'une telle indemnité lors de la rupture de la convention,
puisqu'un tel contrat de travail ne comporte pas d'échéance ; qu'en
décidant néanmoins que Mme X..., engagée pour une durée indéterminée,
était en droit de prétendre au paiement d'une telle indemnité lors de
la rupture du contrat de travail, le Tribunal supérieur d'appel a
violé l'article L. 121-6 du Code du travail applicable à Mayotte ;
Mais attendu que la cour d'appel, qui a retenu que le contrat de
travail écrit aux termes duquel la société a engagé Mme X..., qui
résidait à la Réunion, ne contenait pas la mention de la durée
