Voila, je me présente, Je viens d'avoir 18 ans il y a quelques jours, je vais rentrer en BTS Profession Immobilière à Nantes dans quelques semaines.
Après avoir visité les USA l'année dernière (3 semaines l'été dernier), j'ai eu la chance cette année de renouveler cette d'y repartir pendant 2 mois chez des amies.
La question, je pense que vous vous y attendez. J'aimerais après mon BTS, venir vivre aux USA. Je me suis inscrit à la lottery pour avoir la Green Card mais faut vraiment avoir un gros coup de chance pour l'adopter, c'est pour cela que je me retourne vers une autre solution.
Ma mère, ayant été en voyage scolaire aux USA en 1988, elle a eu la CHANCE d'obtenir un visa permanent, mais on sait fait cambrioler et ils ont emporté cette fameuse carte très précieuse. Savez-vous comment on peut en refaire une demande de copie? Est-ce que ma mère est toujours enregistré ? Apres, si elle peut ré-avoir cette carte, est-ce qu'il est possible grâce a nos liens de parenté, que j'obtienne un visa permanent ?
Si non, est-ce que vous auriez des idées de solutions ou de recherche à effectuer pour obtenir ce visa ? Notre objectif est de pouvoir investir aux USA ( dans la pierre et non pas dans une entreprise). On nous a parlez d'un visa " d'investisseur " mais cela nous intéressent pas car le statue demander n'est pas celui que nous allons adopter.

Le fait que ta mère s'est fait voler sa carte n'a rien à voir, si elle ne vit plus aux États-Unis elle a perdu le statut de résidente permanente depuis longtemps. 😉 La carte c'est juste un document administratif (ce n'est pas la carte qui donne le statut mais plutôt le statut qui donne la carte!). Lorsqu'un immigrant quitte son pays d'adoption pour s'installer ailleurs il perd le droit d'y habiter.
Donc à moins qu'elle ait obtenu la citoyenneté américaine entre temps (ce qui fait que tu serais peut-être américain par le fait même) il faut passer par les procédures habituelles pour devenir résident US:
- visa investisseur type E: il y a différents types de ce visa mais pour les détails faudrait contacter le site de l'immigration et plus tard un avocat à qui vous allez présenter votre dossier (incluant business plan, investissements, etc.).
-mariage avec un(e) Américaine
-loterie (strictement basé sur le hasard et encore le fait que ton nom soit tiré ne garantie rien)
Le fait que ta mère ait déjà eu une green card ne change rien, il faut recommencer la procédure à zéro.😉

Par contre, ma mère a eu sa carte juste lors d'un séjours au USA et donc en aucun cas un statue qui avait besoin de cette carte. Et ma mère est Française mais elle a eu son visa permanent (visa permanent = visa qui se perd pas dans aucun des cas ?? ), ce visa est lié par le faite que l'on réside ou pas dans le pays ?
Ça fonctionne peut-etre différemment en France mais au Canada et aux États-Unis, un résident permanent dans le sens strict des termes de l'immigration est soumis à des obligations, dont celui de vivre sur le territoire. La green card (résidence permanente) est un statut légal que l'on perd lorsqu'on n'habite plus dans le pays.
Cela n'est pas la même chose pour un citoyen (nationalité) américain qui n'est jamais considéré comme un résident permanent mais comme un Américain, tout simplement, conservant tous les droits dont celui de vivre ailleurs tout en conservant sa nationalité. Un résident permanent reste un étranger à qui on lui a octroyé le droit de vivre à long terme aux États-Unis. Mais il perd ce droit s'il ne respecte pas ses obligations (pas faire de criminalité, pas s'absenter du pays trop longtemps, etc.)
Contrairement à ce que tu penses une personne qui obtient une Green Card est OBLIGÉE de vivre aux États-Unis!
Il ne faut pas confondre le terme lexique "résidence permanente" avec le terme juridique de la loi sur l'immigration...
Si tu dis que ta mère a déjà été résidente permanente dans le sens où elle avait immigré aux États-Unis (= green card) elle n'a plus ce statut car elle l'a perdu lorsqu'elle s'est réinstallée en France. Elle n'a plus aucun statut légal dans ce pays depuis longtemps. Normalement, elle est au courant de tout cela.

Je pense que c'est différent de la Carte Verte. Car ça n'aurait pas de sens de donner une Carte Verte à une personne qui vient en voyage scolaire. Sinon, des millions de gens l'auraient obtenue "sans rien faire".

Indefinite validity visas (Burroughs Visas) are tourist/business visas manually stamped into a traveler’s passport which were valid for ten years. Effective April 1, 2004, all indefinite validity Burroughs visas became void. Therefore, if you have an indefinite validity visa you must apply for a new visa for travel to the U.S.

Je pense que les visas étaient tous permanents dans les années 80.
Mon mari avait eu un nonimmigrant visa B1-B2 Indefinitely en 1987, pour 1 semaine de boulot aux Etats-Unis.
Et comme nos 3 enfants figuraient sur le passeport, tous les 4 avaient un visa permanent pour les USA 😉
Mais tout ça c'est fini depuis bien longtemps, plus de visa permanent, plus d'enfants sur le passeport des parents….
Je viens de retrouver le passeport, si ça t'intéresse je t'envoie la copie.
Il n'y avait pas grand chose sur le visa : le n° et la nature du visa.
Nous au Canada jusqu'à tout récemment on n'avait même pas besoin de passeport! On se présentait à la frontière, on nous demandait si on était Canadiens, parfois fallait montrer un certificat de naissance mais c'est tout...
