Aprés avoir passé 1 an en chine (hubei) en tant que profs de français, ma femme et moi plannifions maintenant de nous installer en Chine
pour quelques tant et d'y ouvrir un commerce genre hotel - restaurant.
Bien sûr il apparait que l'entreprise ne s'avere pas des plus facile et sera surement longue et fastidieuse.J'ai donc
pensé que les membres du forum pourrait nous eclairer sur pas mal de points et nous apporter leurs experiences ou leur
savoir sur le sujet. Cela interessera egalement, je pense beucoup d'autres personnes.
Je précise que si nous nous engagons dans ce projet, nous le ferions avec un couple de chinois. Je pense que cela est indispensable
tant au niveau du probleme culturel que légal.
Donc voici pour commencer les 2 principales questions que l'on s'est posé :
1/ Connaissez-vous les droits en terme d'acquisition d'un bien immobilier en chine lorsque l'on est etranger ?
Peut-on acheter n'importe quel bien immobilier, n'importe où en Chine ?
Il se peut meme qu'il soit plus simple de louer ou meme de construire.
2/ Connaissez vous les droits en terme d'acquisition de fond de commerce ou des differentes voies afin de pouvoir créer
un restaurant, café ou hotel pour les etranger ? Faut-il créer une société ?
Il y a bien sûr beaucoup beaucoup d'autres interrogations, mais ces 2 points primordiaux me semblent déjà etre un gros morceau.
il va de soi que la mise en relation avec des etrangers francais ou anglophones s'averera indispensable, aussi peut etre connaissez vous des
personnes ayant vecu la meme experience ou qui nous conseillerons, ainsi que des organismes (je vais deja me renseigner auprés des organismes publics officiels francais en chine genre chambre du commerce et
ambassades).
je connait toute vos questions, mais je suis tres presse donc aujourd'hui je vais repondre qu'au sujet de l'achat.
Il est vrais qu'on ne peut pas tout faire en chine.
La premiere chose, est la construction. Un etranger n'a pas le droit de construire en chine. Vous pouvez cependant louer oubien acheter.
Il faut faire bien attention a tout cela. J'ai achete des appartements en chine, je sais tres bien comment cela ce passe.
Quand vous acheter quelque chose (maison, appartement, ....) Il vous appartiendra pour 70 ans. Apres cette periode le gouvernement peut choisir de le reprendre en vous dedomageant ou pas (ce n'est pas oblige qu'il dedomage). Si le gouvernement veut le recuperer avant ces 70 ans, il le peut, mais il vous donner quelque chose pour cela.
Ensuite vous ne pouvez pas acheter n'importe quoi. Il faut penser que peut etre vous voudriez revendre apres !
Au moment d'acheter il faut bien verifier que celui qui vous vend la maison peut bien vous donner tout les papiers corresspondant a la propriete. Il se trouve, que on peut acheter des maisons pour vraiment vraiment pas chers, mais le revers de la medaille est que ce sera IMPOSSIBLE de le revendre !
Autre chose, si vous achete pas du neuf, il faut verifier que le batiment n'est pas trop vieux. Auquel cas il faut eviter de prendre.
Pour ce qui est de faire un commerce, cela s'apparante simplement a une entreprise. Quoi que vous fassiez pour etre legal il vous faudra ouvrir une companie. Pour des etranger cela n'est pas dutout evident. Il faut envoyer en chine une somme d'argent importante 1M !! et ensuite vous pourrez difficilement ressortir cette argent de chine sans explication valabe.
Ce n'est pas evident, mais votre projet est tout a fait faisable, mais pas dutout en petit. Il sera valable uniquement si vous voulez reellement faire un grand restaurant. Dans un endroit avec beaucoup influance et de personne ....
Merci pour ces précisions. Nous allons effectivement prendre notre temps et faire tres attention. Nous allons revenir en chine en Avril 2006 et rester y travailler pendant 1 an (vers WUHAN). Nous aurons alors l'occasion de nous renseigner concernant les demarches et de visiter les regions qui nous plaisent.
Au sujet de la creation d'entreprise, vous parler d'une somme de 1M, est-ce 1 Millions d'euros ? On nous avait parlé d'un apport de 50 000 €.
Et vous, ou habitez vous ?
pour un etranger c'est 1 Millions de yuan (100 000euro).
Pour les chinois le capital est effectivement moin eleve que pour un etrange.
Ceci dit ! je tiens a preciser une chose.
ce 1M c'est pour ouvrir un bureau, une usine, ....
Mais pour ce qui concerne la restoration je doit avouer ne pas savoir avec presision.
Et ta question de savoir ou j'habite est tres bien et tres importante. Je suis dans le sud, pres de shenzhen.
Il est vrais que le capital varie en fonction du lieu.
