Montpellier-Fez flight canceled by Air Arabia: group action?
FR

My Montpellier-Fez flight was canceled by Air Arabia and rescheduled with only 1 day on site instead of 4, making the trip pointless. Customer service is unresponsive. If you’re also affected by this flight (or a similar one), join me to consider a group action. Contact me here or via DM! #AirArabia #PassengerRights

Hello,

In France, class actions in court are STRICTLY reserved for accredited consumer associations. And given the conditions, they’re not exactly lining up for it!

Otherwise, the action can only be individual, not collective.

In case of a flight cancellation (no matter how far in advance), if the flight falls under EU Regulation 261/2004 of the European Parliament and Council, under Articles 5 and 8, the airline is REQUIRED to offer a choice between: - a refund of the ticket within 7 days - re-routing as soon as possible (whether on one of its own flights or on flights from another airline) - re-routing at a later date if that’s the passenger’s choice.

The passenger’s choice among these options is final and irrevocable.

If the cancellation occurs less than 14 days before the flight, whether re-routed or not, the passenger is entitled to compensation (250 €, 400 €, or 600 € depending on the distance).

But the airline CANNOT automatically impose re-routing on different dates.

You have no other rights than those defined above.

EU Regulation 261/2004 applies to all flights departing from the European Union, as well as flights arriving in the EU—but in the latter case, only if the flight is operated by a European airline. The return flight is a separate flight from the outbound one.

Thanks, that’s very clear!

We’ll follow your suggestion.

Let’s stay in touch if we can help push airlines to consider their passengers better.

Hi Benoistx,

We’re having trouble with Air Arabia, who cancelled our flight from Barcelona to Fez. We’ve been trying to reach them for days (email, phone, chat, etc.). Finally, we managed to get through on a premium-rate number, but—wouldn’t you know it—their system wasn’t working. They were supposed to call us back, but nothing. I think we’re in a real mess here—it’s five seats we paid for. What can we do? Thanks in advance. We’d like to join your collective action.

Hi everyone,

I suggest you check out their Facebook page. Personally, I left a comment and a ticket was automatically created for me. Since then, I’ve been in touch with customer service about my issue.

You can also use the WhatsApp app, which will create a ticket for you. They should get back to you by email afterward.

Best regards,

Hi there,

Facebook, email, WhatsApp... So many complications for something simple! The most effective way to handle this is to forget the internet even exists and send a registered letter with acknowledgment of receipt.

When it comes to a simple refund request for a flight canceled by the airline, check this out: https://retardimportantavion.wordpress.com/2023/05/03/vol-annule-droit-indiscutable-au-remboursement-si-pas-reachemine-voucher-uniquement-si-accord-du-passager/
