Voici ma situation: je suis française, j'ai bientôt 22 ans. Ma mère est française, mon père double nationalité franco-américaine.
J'ai une première question:
Ayant un père américain, j'ai donc le droit de demander la carte verte, mais comme j'ai plus de 21 ans je ne l'aurai pas directement et visiblement l'attente pour ma catégorie (F1) est de... 5 à 6 ans! J'ai pourtant lu sur certains sites que c'est 2 ans, ce qui serait parfait, mais sur le site officiel apparemment ils traitent en ce moment les dossiers F1 de 2006... Si quelqu'un pouvait m'éclairer là-dessus.
Je suis consciente que c'est déjà un "luxe" d'avoir la garanti d'obtenir la Carte Verte un jour, sachant à quel point il est difficile d'immigrer aux Etats-Unis, mais je me dis que 5 ou 6 ans ça me laisse le temps de "trop" construire ma vie en France et finalement ne plus pouvoir partir. Alors je me demandais si c'était possible de tenter la loterie pendant cette attente en ayant peut-être la chance de l'obtenir avant, ou si cela était illégal de cumuler la demande par liens familiaux ET la loterie.
Question débile et je pense connaître la réponse mais on sait jamais l'espoir fait vivre: les enfants de moins de 21 ans, c'est 21 ans non-inclue? Ou si on a 21 ans (et 11 mois lol) on a encore sa chance pour l'avoir directement?
Deuxième question:
Je suis en couple depuis 3 ans, nous ne sommes pas mariés. La catégorie F1 avec 5 à 6 ans d'attente concerne les enfants non mariés de citoyens américains. Si je me marie, j'entre dans la catégorie F3 et l'attente se prolonge à presque 10 ans! Alors voilà, si j'obtenais la Carte Verte, comment cela se déroulerait-il avec mon copain? J'ai lu que pour le conjoint de quelqu'un ayant la GC, l'attente était d'environ 7 ans, relation à distance pendant 7 ans c'est juste impossible. Alors même si la GC prend 7 ans, mon copain pourra-t-il obtenir un Visa ou une autorisation pour venir vivre aux Etats-Unis avec moi et y travailler en attendant?
Et au final qu'est ce qui est le plus intéressant: me marier puis faire la demande de GC ou obtenir la GC puis me marier?
Evidemment cela suppose que tes parents ont déclaré ta naissance au consulat, mais ce serait étonnant qu'ils ne l'aient pas fait?
Si l'un de tes parents réside aux US, la situation est différente, de même que si un de tes grands parents te sponsorise. Mais tout cela
est extrêmement compliqué. Tu dois donc passer par un avocat spécialisé.
En tous cas clairement tu ne peux pas te marier tant que ta situation légale n'est pas réglée puisqu'il y a une catégorie spécifique pour les enfants
de citoyen US non mariés et que celle-ci est beaucoup plus favorable. (Etre bloqué sur ce point arrive hélas fréquemment).

tu aurais tout simplement une double nationalité.
la raison pour laquelle c'est compliqué de devenir immigré permanent pour toi c'est que... c'est assez inédit de vouloir être immigré dans son propre pays (en tant qu'enfant de citoyen américain, tu as le droit d'être citoyenne américaine même si c'est plus compliqué quand on est majeur).
Si tes parents n'ont pas déclaré ta naissance avant ton 18e anniversaire alors là ça devient plus compliqué.
Tu n'as pas des grands parents à qui tu rends visite? Des cousins chez qui tu allais quand tu étais petite? Tu en parles comme si tu n'y étais jamais allée...
C'est extrêmement rare qu'un parent venant de l'étranger ne déclare pas la naissance de son enfant à son consulat...
Demande à tes parents, mais normalement tu as déjà la nationalité américaine et tu ne peux demander la carte verte 😉 C'est comme si un Français demandait à avoir un permis de séjour pour pouvoir vivre en France! LOL

Bien cela n'a rien d'illogique en fait, quand tu nais d'un parent tu obtiens automatiquement la nationalité, sinon comment serais-tu devenu Français? 😉 Quand tu es né en France, tes parents t'ont enregistré à la mairie (ou à l'État civil, je ne sais pas comment ça fonctionne chez vous). Donc le faire au consulat c'est exactement la même formalité, y'a juste l'endroit qui change.
Le green card c'est différent, tu es un étranger donc il y a un processus puisque tu n'as aucun droit à vivre dans le pays.

Bien il n'y a rien de très compliqué, tu appelles ton père et tu lui demandes si lors de ta naissance il a enregistré l'événement au consulat, s'il dit oui tu es probablement américaine mais il faudra vérifier auprès de l'ambassade pour obtenir le passeport. Je sais que dans certains pays, si un enfant ne revient pas vivre dans le pays de son parent avant un certain âge, il peut perdre sa nationalité, mais les règles changent constamment et cela dépend des pays. Au Canada, l'âge fixé était de 24 ans si l'enfant canadien était né à l'étranger.
