Nous sommes un couple (30ans) de Paris qui avons pour projet de s'installer prochainement aux Philippines. Différents voyages en Asie du Sud-Est nous auront finalement conquis pour prendre la décision d'orienter différemment notre vie.
Nos jobs actuels sont de bonnes place (tout du moins à ce qu'on dit), mais notre désir est vraiment de passer à autre chose...
Après la lecure de plusieurs discussions sur ce forum et plusieurs recherches sur Internet, nous souhaiterions pouvoir profiter de l'expérience et aide de personnes installées ou connaissant très très bien les Philippines.
L'iobjectif serait d'ouvrir un business ou travailler (formation et expérience financière) sur place afin de pouvoir nous installer dans les Visays (la situation et l'ile exacte restent à définir).
Toutefois avant de partir définitivement sur place, nous voudrions solliciter votre aide ou orientation sur divers sujets (financement, relations etc...):
-Dans le cas où nous envisagerions de monter une corporation pour l'ouverture d'un business (à définir même si l'envie d'un hotel/ Guesthouse, restaurant nous donne envie), quels sont les moyens et intermédiaires permettant de mettre en relation des investisseurs pour trouver des associés?
-Pouvons-nous trouver des terrains à louer sans avoir à tourner d'iles en iles?
-Concernant le budget nécessaire à la création d'un business ou achats quel est selon vous le budget permettant un apport minimum? Dans le cas d'un complément de financement, savez-vous si des crédits peuvent être octroyés aux étrangers pour ce genre de business?
Du temps et une installation préalable (pourquoi pas travailler sur place) nous semblent indispensables , néanmoins un premier retour d'expériences nous parait intéressant.
Lors de nos différentes rencontres aux Philippines, nous avons rencontré plusieurs étrangers dont français qui avaient ouvert un business sans toutefois être marié à un local. Par ailleurs, vous indiquez 'en règle général', ce qui signifie surement que d'autres moyens existent.
Auriez-vous des informations et expériences par rapport aux questions soulevées dans mon post précédent?
Oui bien -sûr les lois sont faites pour être contournées😉, vous pouvez utiliser un prête- nom mais çà reste extrêmement risqué le ou la philippine étant le véritable propriétaire, la moindre divergence de point de vue peut- être catastrophique pour vous , mais il y a des exemples ou celà fonctionne...Mais restez extrêmement prudents..En outre choisissez un business qui ne peut -être copié par les philippins (exemple : la restauration , ou un business demandant une technologie pointue) bonne chance à vous dans tous les cas...
L'idée est d'ouvrir un business centré sur le tourismes (guesthouse, hotel, restaurant).
Que ce soit le fait de trouver des pretes noms ou pas, le premier point consiste à trouver des partenaires locaux et de louer un terrain.
Si quelqu'un à des idées (sites, expériences) ou contacts nous sommes preneurs car à la différence d'autres pays, cela semble plus complexe.
En ce qui concerne la recherche de location de terrain, visitez www.sulit.com.ph, le site incontournable pour les affaires, prenez contact avec les vendeurs et discutez avec eux. En plus, sulit.com est utile dans bien d'autres domaines.
Vous ne pourrez pas acheter de terrain aux philippines en tant qu'étranger. seuls les nationaux le peuvent. Vous pouvez néanmoins obtenir des baux de 50 ans renouvelable une fois (soit 100 ans) sur lesquels vous pourrez faire construire.
Si vous envisagez de créer une société, sachez que 60% des parts devront être aux mains de philippins, se seront des silent-partners qui seront choisis par un avocat. Le coût de création d'une société par un avocat (indispensable) est d'environ 1000 à 3000 euros pour des business jusqu'à une création de resort.
Vous devrez ensuite voir avec votre avocat pour les visas de travail, l'inscription au BRI etc...

Compte tenu que vous semblez bien connaître le pays, connaitriez vous un cabinet de confiance vers lequel nous tourner? Ceci nous permettre aussi d'avoir un peu plus d’éclaircissement sur les délais d'obtentions de visa car le DTI et DOT sont assez vague.

le poste date, mais il y a tellement de choses fausses, que ca me revolte lol.
Il est possible d etre proprio aux philippines, sans utiliser les methodes illegales que sont les pretes noms et associés silencieux (cherchez nominee et PLDT voir Ayala aussi), pourquoi? qui dit partenaire, dit remuneration du partenaire, s ils epluchent vos comptes... ils ciblent bien evidemment plus facilement les etrangers, bien plus solvables, que les locaux, ils verront bien que vos partenaires ne sont pas remunérés.
-le condominium, proprio à 100%, le terrain appartient a la collectivité. dans la limite de 40% d etrangers, comme une societe.
le condo verticale, immeuble, et condo horizontal, qui sont des lots/terrains en collectivité construits ou non.
De nombreux terrains sont en subdivision en bord de plage, un peu partout, San vicente, badia heighs
-acheter au nom de la société. Normalement les sociétés c est 40% etranger et 60% philippin...
mais il y a plusieurs exceptions, comme les societés d export ou vous pouvez etre 100% proprio
-le leasing comme ennoncé, vous jouissez du terrain comme bon vous semble, la durée est definissable par le proprio voir un accord entre vous.
Les philippines, comme nombreux pays asiatiques, veulent les capitaux etrangers, mais sans rien donner en echange....le beurre et l argent du beurre trouve toute sa signification ici.

Étant donné la difficulté de création d'une société aux Philippines je te conseillerais vivement de faire appel à une société locale, ca te fera gagner beaucoup de temps et d'argent. Je peux te recommander Infinit3solutions (dirigée par un français donc assez pratique).
