J'espère que quelqu'un pourra m'aider à répondre aux questions que je me poses je suis très anxieux, je pars dans quinze à Los Angeles, il y a 8 ans, j'ai reçu une convocation de la police suite à un simple délit d'erreur de jeunesse que j'ai fais. En l'occurance vol simple + falsification de cheque ... Je sais ce n'est pas bien...
Aujourd'hui j'en paye le prix, car je n'avais pas conscience que le passage à la douane americaine etait si difficile que cela.
Je suis quelqu'un qui aujourd'hui gagne sa vie, je suis honnête et je voudrais juste partir là bas 10 jours en vacances.
J'ai remplis le formulaire de l'ESTA, je n'ai pas coché oui à la question ou on me demande si j'ai été arrêté etc... Car en ma conscience, je me suis rendu moi même après convocation... J'ai effectivement un casier judiciaire qui date de 8 ans, je n'ai jamais été condamné, je suis repartis tel quel, seul le casier judiciaire reste !
C'est l'horreur pour moi, je me rend malade, j'ai peur de faire 11h de vol et qu'on me demande de faire demi tour.
Svp si vous avez le moindre réconfort je ne pourrais pas plus vous remercier.
Bonjour, ce n'est pas la douane qui pose problème mais la police de controle aux frontières, et si tu n'as pas été condamné devant un tribunal, avec sanction (prison ou travaux d'interet général) tu n'as pas de trace sur ton casier judiciaire. De plus il y a plusieurs niveaux de délits classifiés dans les casiers et seuls les délits criminels peuvent etre signalés aux polices étrangères. Donc ne t'en fait pas et voyage sans angoisse.

Le casier judiciaire conserve les condamnations prononcées par les juridictions pénales (cours d'assises, cours d'assises des mineurs, cours d'appel, tribunaux correctionnels, tribunaux de police, tribunaux pour enfants, juges des enfants).
Il conserve aussi certaines décisions prononcées parles tribunaux de commerce (liquidation judiciaire, faillite personnelle, interdiction commerciale) et certaines décisions administratives et disciplinaires quand elles édictent ou entraînent des incapacités même lorsqu'elles n'ont pas été prononcées.
Dans le cas qui nous est présenté, si pas de jugement, pas de casier...

Effectivement, je pense que vous avez raison, toutefois je tiens à préciser qu'à l'époque, on m'a prit mes empruntes, prit en photo, garde à vue et déposition ( Que du bonheur ) pour le reste vous le savez déjà, je n'ai jamais pris de condamnation, mais je sais que ce dossier existe, car il y a de cela j'ai 6 ans j'ai voulu travailler en agent d'accueil sous douane et la préfècture ma envoyé sur les roses ressortant ce fichu document avec le délit constaté.
Il semblerait que je fasses finalement partis d'un fichier qui s'appellerait "STIC", je constate sur wikipedia quand on tape "ESTA" et que l'on voit qu'ils vont chercher toute ta vie, je sais d'avance que je suis fichu, si j'avais si je ne me serais pas engagé à partir là bas, je suis vraiment triste, j'ai l'impression que de toute façon c'est perdu d'avance.
J'ai coché non à la case si je ne m'etais déjà fait arrêté blabla... Desolée d'intervenir de manière un peu naïve mais il me semble que si toutes les personnes qui avaient un délit mineur inscrit sur leur casier judiciaire datant d'il y a quelques années sans aucun écart depuis, ne pouvaient pas se rendre aux Etats unis, ça ferait un paquet de monde... Demandes d'abord à voir ton casier judiciaire (tu peux en faire la demande ici https://www.cjn.justice.gouv.fr/cjn/b3/eje20). Si ça se trouve il n'y a pas grand chose qui t'empêchera d'aller aux Etats Unis. C''est un peu différent quand il s'agit de poser une candidature pour un poste au niveau des douanes qui sont un peu "critiques". je pense que tu angoisse pour pas grand chose mais demande à voir ton casier au moins tu seras fixé pour de bon.
Votre casier judiciaire est vierge (demandez le bulletin N°3 à Nantes).
Par contre, vous devez être fiché dans le fichier STIC.
Vous avez répondu non sur le formulaire et les autorités américaines n'ont pas accès à ce fichier.

et il y a le fichier d'Interpol.
Il a de la chance, car vol et falsification d'un chèque, cela peut coûter très cher.

Des 3 bulletins disponibles pour le casier judiciaire, le n° 3 est le seul que puisse vous demander les autorités américaines car les 2 autres ne peuvent pas vous être transmis et la France ne les transmettra pas à des autorités étrangères.
Bulletin N°2 : Il ne peut être remis qu'à certaines autorités administratives pour des motifs limitativement énumérés (accès à un emploi public, à certaines professions, obtention d'une distinction honorifique par exemple).
Bulletin N°1 : Ce bulletin ne peut être remis qu'aux autorités judiciaires.
En même temps n'importe qui peut être sur le STIC y compris les victimes. Dès que vous avez affaire à la police. Autant dire qu'il doit y avoir une bonne partie de la population qui en a un (peut être que j'en ai un). Et pour le consulter ça pas l'air aussi simple que ça. En tout cas pas comme pour le casier judiciaire. Quant à ceux de Jonny Hallyday et de Jamel Debbouze, ils ont été révélé illégalement. Du coup ça m'a donné l'occasion d'une conversation très intéressante avec mon juriste de mari (qui lui aussi a fait dans sa jeunesse deux trois bétises assez inoffensives à ces yeux mais pourtant répréhensibles mais bon ça a plus fait marrer les policiers qu'autre chose et il n'a eu ni casier judiciaire ni STIC et il a pu devenir militaire et être habilité secret défense, être jeune c'est dangeureux pour l'avenir). En gros, oui les autorité américaines peuvent avoir accès au STIC mais seulement dans le cadre d'une commission rogatoire (dans des coopérations internationales) c'est à dire si un juge américain en fait la demande. Comme ils ne s'amusent pas à regarder pour tout le monde, à moins d'être soupçonné de manœuvres terroristes ou de malversations financières tu ne crains pas grand chose... Et puis, toujours d'après lui, les délits financiers ne sont pas la priorité des américains (pas comme la drogue ou autre). DOnc franchement tu crains pas grand chose. On peut demander son STIC auprès de la CNIL mais ça prend un peu de temps.
cela dit ces histoires de STIC c'est assez édifiant quand on sait que 30% des fichiers sont faux ou périmés. Lecture conseillée: http://bugbrother.blog.lemonde.fr/ et le site de maitre Eolas qui parle pas mal de ces fichiers et du débats sur Edwige (c'est assez technique mais ça plaira au juriste) http://www.maitre-eolas.fr/

Je suis cette conversation depuis le début et je me demande une chose...
N'ayant pas été "condamné" ou "jugé" (?)... peux -tu penser que faire un aller-retour de 11h00 (X2) serait cher payé aux yeux de ta "victime" qui elle aussi, je pense, à dû souffrir et angoisser, a eu besoin d'être aidée, rassurée, etc...?
Pour avoir été victime, moi-même, d'une malversation identique (dont j'ai mis plusieurs années à me rétablir) ... 22 heures d'avion sans pouvoir sortir... c'est plus que ce qui a été donné à cette personne.
Je ne suis pas super fâché mais juste un peu contrarié par cette petite langue de bois.
Un peu de retenue dans la complainte serait donc de bon ton.
Bon voyage quand même, si tu passes. Les USA sont vraiment dignes d'intérêt.
Je n'ai pas dormis de la nuit, j'en ai même rendu mon repas de la veille.
J'ai reçu un message transverse ou l'on me dit que certaines personnes sous contrôles judicaires arrivent quand même à y aller.
Je sens qu'il va me falloir pas mal de pilule pour déstresser le jour J, parce que si ca se trouve je suis en train de m'aubreuver de bétîses, et de plus le sujet est beaucoup plsu elevé avec les canadiens, l'etau est resserré, j'ai peur, va falloir que je garde mon self controle et être souriant, une fois passé le contrôle je crois bien que je vais en pleurer
Enfin bref, ce serait à côté je m'en ficherais mais 11h de vol et 2000 euros financés c'est quand même pas rien.

A priori, je doute que les données soient croisées au niveau des aéroports. Il y a une différence entre travailler dans un aéroport ( et là, les autorités ne recrutent que des gens sans "traces" !) et voyager. Aucun souci pour te rendre aux USA même si fiché au STIC. Je connais des gens qui - même sous contrôle judiciaire- peuvent voyager à l'étranger ! No souci !

J'ai un problème similaire j'aimerais savoir comment se passe le passage au poste frontalier car ma demande d'ESTA à été accordée (j'ai cocher non à la fameuse case) pourtant j'ai un mois de sursis pour conduite en état d'ivresse. Cela va t il me poser problème? Je part lundi en Floride.

Je n'ai pas eu a utiliser mon formulaire ESTA ni à l'embarquement à Roissy ni à Los Angeles, tu es sûrement déjà enregistré dans leurs fichiers depuis ta demande d'autorisation, mais prend avec toi en bagage à main tous les documents de ton séjour là bas plus ce fameux formulaire.
A Roissy, avant d'embarquer, on va te donner une autre carte à remplir pour l'arrivée à l'immigration americaine, c'est quasi la même chose que le formulaire ESTA, tu vas devoir recocher la même chose ! Tu auras peut être plus de chance que moi, mais déjà en france avant l'embarquement, une personne agrée a fait le tour de chacun de nous, avec un ton assez sec et pose des questions rapides pour savoir ! Combien de temps tu restes, ou est ce que tu vas, et quelle est la date de ton retour, question piège surement pour faire correspondre la premiere et dernière question.
Une fois dans l'avion, bon vol !
Arrivé sur le sol americain, ne stresse pas, on est déjà fatigué moi 11h30 de vol lol avec Air France. Tu vas voir, le premier passage, c'est celui de l'immigration, tu vas entendre un Nexxxt, c'est à toi, tu donnes ton passeport ainsi que le petit carton que tu as remplis dans l'avion et tu vas être fixé direct ! ( Ne dépassse pas la ligne jaune attend qu'on t'appelle )
Ils vont te demande de poser tes 4 doigts de la main droite sur un scanner puis de ta main gauche ensuite ils vont prendrent une photo de ta rétine et la c'est gagné, reste le plus naturel possible, n'angoisse pas moi je me suis rendu malade pour rien mais je me suis concentré pour ne pas montrer que j'avais peur, sourit !
Une fois que tu vas passer l'immigration c'est déjà gagné mais avant de sortir de l'aéroport on va te reposer la question à savoir ou est ce que tu vas nia nia nia, sort tes documents et l'histoire est reglé moi c'est ce que j'ai fais.
Voilà, ça me fait bizarre de lire ton message, parce que j'ai partagé cette même angoisse, mais j'ai bien été soutenu ici ! Le tout c'est vraiment de se faire confiance, je ne sais pas absolument pas si tu risques de te faire squeezé, est ce que tu as un casier judiciaire ? Moi je sais que non finalement.
Et puis quand tu vois des personnes comme Paris Hilton qui fait de la tole pour conduite en etat d'ivresse qui continue de voyager, je pense qu'ils ne cherchent pas à évincer ce genre de personnes, mais plus des personnes avec un passé plus ou moins dangereux pour la société ( Meurtre, casse, braquage, viol et j'en passe ... )

Reste à savoir si la condmnation avec sursis a un impact pour te rendre sur le territoire.
J'aurai été toi, j'aurai demandé le formulaire n°3 d'extrait de casier judiciaire afin de savoir si quelque chose y figure, le sursis ne doit peut être pas compter ?!
salut kalichou donc j'ai pu rentrer sur le territoire americain^^ un seul controle d'immigration a philadelphie avec un interrogatoire asses poussé mais pas d'allusion a un eventuel casier, le seule probleme que j'ai eut c'est a lisbonne ou on ma demander l'adresse exacte ou j'allais, chose que je n'avais pas car je voulais trouver un motel sur place donc ils ne voulaient pas me faire embarquer mais heureusement google est la j'ai pu leurs sortir une adresse d'un motel au pif :) ouf! I’m a bit embarrassed because I need to travel to Quebec from February 27th to March 13th. I’m a regular visitor to Canada—this will be my 10th trip since 1997, plus a year as a permanent resident (2000–2001) and a cross-country run from Vancouver to Halifax in 2011. So, I’m definitely not a terrorist!
But since our last trip in July 2015, they’ve introduced this eTA thing. Seems more like a way to make money than to actually secure Canada, if you ask me, but anyway, that’s not the point.
I applied for an eTA for myself, my wife, and our two kids. They all got approved within hours, but not me! I was asked to create a GC key and then an IRCC account, which I did. Normally, you get news within 72 hours, but since Monday, January 15th, nothing!
In the "message" section of the account, it says "explanation letter (required)" with a deadline of January 25th, but I can’t find any explanation anywhere—despite searching the Canadian government website and Google. No links, nothing!
I’ve emailed them but haven’t heard back yet. I’m thinking of calling the Canadian embassy in Paris tomorrow. Even though I’m not stressing yet, it’d be a bummer if everyone else got to go without me!
If anyone’s had this issue before or knows what this explanation letter is about, I’d love to hear more.

I’ve tried my hotel, the Lotte Hotel (which is well-known in Seoul), the airport—basically, I’ve entered at least 20 addresses, all rejected....

I’m planning a trip from France to Alberta/British Columbia, and I’m unsure about which bank card to use for the security deposit with the rental company (I’m thinking of going with AVIS).
I contacted Avis Canada, and they told me a credit card is absolutely required. I asked my bank for a credit card (a *real* credit card), but they only offered me a deferred debit card.
My question: For a rental with Avis Canada, is a Gold International Mastercard deferred debit card usable for the security deposit needed to finalize the rental? Is the "CREDIT" label enough? (Some cards say "CREDIT" and others say "CARTE DE CREDIT"—seems minor, but it’s actually a big deal in how the card works.)
I’ve seen conflicting info everywhere I look... My bank says it’s *usually* okay (the deferred debit card), while Avis Canada insists it *must* be a credit card, not debit—even when I mention the deferred debit card.
I know the whole credit card concept is already confusing, and on top of that, some sites say a deferred debit card counts as a credit card, while others say it doesn’t.

I bought a one-way flight (Ryanair) and a return flight (EasyJet) to spend a week in Morocco in April.
My passport expires 3 weeks after the return date.
Some websites say the passport must be valid for 3 months at the time of entry.
However, it will still be valid both on entry and return, but its validity will only be 1 month at the time of entry (and 3 weeks on the return date, everything prepaid).
It's an individual family trip.

Last year, we stayed for 3 months in Thailand, north of Khao Lak, and were able to benefit from the 2-month visa exemption, renewable for one month by going to Takua Pa to validate a 1-month extension (1,900 baht).
This year, it’s a disaster for us—not only were we planning a 4-month stay, adding a visa run in between (which some say is quite risky), but the law is apparently changing in the coming months with the return of the 1-month exemption (plus the usual 1-month option). So, we looked into applying for a 6-month multiple-entry visa, allowing a maximum of 60 consecutive days in Thailand. However, I can’t find anywhere the minimum time required outside Thailand between two stays—do any of you have an idea?

We’ll soon be moving to Madagascar long-term.
As a French national, I need to obtain a short-stay visa that can be converted to a long-stay one. To do this, I have to send the required documents to the Madagascar embassy in Paris.
No issues with that procedure so far.
If I get this visa, once I arrive in Madagascar, I’ll need to provide the same documents to the Ministry of the Interior in Anosy. I’m trying to find an email address or website for the Ministry to check which documents I need to submit (I think they ask for additional ones).
If you have any info on this, I’d appreciate your replies.

I’d like to know if anyone has already applied for a private visa to Russia with an invitation from a Russian resident.
I traveled earlier this year with an e-visa, but since I want to stay longer, I’ll be visiting my friend who lives in eastern Russia.
For the visa application, does the invitation need to be on an official paper form issued by the Russian ministry? And most importantly, do I need to present the original for the application, or is there an electronic version that can be sent directly to the consulate in France?

I filled out the B2 form to apply for a visa, created an account on Atvis to pay the visa fees and schedule a meet-up, but every time I try to pay with my Boursobank Visa 1st card, they refuse the payment with a message telling me to check my details (address), even though everything is correct. Does anyone know why this is happening, or maybe they don’t accept Visa cards? Are you aware of this?

I’ve read that China may ask for proof of exit within 30 days (flight ticket or other reservation). Since we’d be leaving by land, I’m wondering how this works in practice.

On her ticket, it only has her maiden name (e.g., Martine DUPOND).
On her passport, it’s written as Martine DUPOND épouse AVRY.
No issues for travel, I hope I did the right thing with the ticket?
Then for the ESTA, is just Martine DUPOND enough, or do I need to include the "épouse AVRY" part like on the passport?

I saw on the French Embassy in Peru’s website and the Peruvian Consulate in Paris’s site that the rule is to have a passport valid for 6 months *after the arrival date* (not the return date).
I arrive in Peru on August 13, 2019 (for about twelve days), and my passport is valid until February 16, 2020.
That’s 6 months and 3 days after my arrival date in Peru. In my opinion, I’m good to go.
But could I still be denied entry if they say I don’t cover the return date or that I’m too close to the 6-month mark?

My departure is slowly approaching, and now that I’ve got my Russian visa sorted, I’m fine-tuning the rest of my trip to Tajikistan. Since the Tajik visa is no longer required for stays under 30 days (for French nationals), I’ll need to visit the Ministry of Interior (OVIR) to register within 10 days of entering the country. No big deal, though, since I had to go there anyway to apply for my GBAO permit. 😉 However, I’ve *seen* several reports from travelers (mostly motorized) mentioning that you need an entry permit for Kyrgyzstan, which has to be arranged in advance at the Kyrgyz Ministry (consulate?) in Dushanbe. Otherwise, you’re *stuck* at the Kyzyl-Art border (with no Wi-Fi, of course, to try and sort it out). The most recent report was from a year ago, so I’d love to know if this is still the case and if it’s indeed at the Kyrgyz Ministry (consulate?) where you need to go for this pre-authorization.

I’m leaving for almost 3 months in the Philippines (11 weeks total) starting in early May.
I already have my round-trip ticket.
The problem is, I don’t have time to get a 2-month visa because the process takes nearly a month.
From what I’ve read here and there, I need a return ticket valid for less than a month when I arrive in the Philippines to prove my good faith.
After that, I can apply for a 30-day extension at the immigration office.
I’m planning to either buy a fully refundable ticket to the nearest country or a fake ticket.
For 3 months, I’ll need to extend my visa two more times before my return date to France.
My question is this:
Will immigration ask me each time I extend my visa by one month to show proof of an exit ticket matching the new visa extension date?
Is it possible to extend directly by 2 months before the initial 30 days expire?

Before arriving, I apply for a TDAC, okay.
If during my stay I cross the border to spend a few days in Malaysia and then re-enter Thailand,
do I need to submit a new TDAC application?
Do I use the same TDAC as when I first entered the country?
Or do I initially have to pay for a Thai multi-entry visa?

My partner (Mexican) entered France on January 21st as a tourist. She was therefore entitled to stay for 90 days in the Schengen Area. She’ll be leaving for Mexico on April 16th, so she’ll have “used up” 86 days.
She plans to return to France on July 18th. According to the European Commission’s Schengen calculator, this new stay “may be authorized for a maximum of 90 days.” That’s not very clear ("may be," "for a maximum of").
The text of Article 6 of the European regulation (2016/399) states that for a stay planned in the territory of the Member States, not exceeding 90 days in any 180-day period, one must examine "the 180-day period preceding each day of the stay." That’s not very clear either.
My partner wants to return to France for a 90-day period starting on July 18th. Is this possible?
There are two ways to look at it:
1) The first day she spent in the Schengen Area was January 21st. That day will drop out of the calculation 180 days later, on July 20th.
From July 20th, she’ll get back 1 day of possible stay; on July 22nd, 2 days; and so on. All the days from her previous stay (January 21st–April 16th) need to be outside the 180-day rolling window.
The last day of her stay was April 16th. Looking 180 days ahead, that brings us to October 13th. From that date, she’ll be able to return for a full 90 days.
2) The number of allowed days is calculated for each day of the new stay. In other words: the 180-day window is recalculated every day, not fixed at the entry date.
If she re-enters France on July 18th, she’ll only have a “credit” of 4 days. But with each day of her new stay, one day from the previous stay (January–April) will drop out of the calculation. The rolling window allows her to “replace” days from the previous stay with those of the new stay, without ever exceeding 90 days in any 180-day period.
In this case, my partner could stay in France for 90 days starting on July 18th.
The Prefecture doesn’t provide any information, nor does Air France, and in the forums I’ve checked, opinions are divided. Thanks for any insights you can share!

We’re planning to travel to Indonesia (Sulawesi with family) next July and August for a stay longer than a month (about 6 weeks).
I’ve seen that it’s possible to get a 60-day visa before departure, but I’ve also read about people having a lot of trouble getting it (some even didn’t manage and had to leave without it).
We absolutely need to have these 4 visas BEFORE leaving because once we’re in Sulawesi, I’m not sure we’ll be able to go to an embassy to request a visa extension after 30 days.
In short, how can we **100% guarantee** that we’ll get our 4 60-day visas before our trip this summer?
