Hello,

Back in February, I booked a flight with Air France-KLM from Lyon to San Diego with a layover in Amsterdam (flights operated by KLM). The flight is scheduled for late August. My Lyon→Amsterdam flight was canceled by KLM in June, and a replacement flight the evening before was booked for me. So, I’ll end up spending the night at Amsterdam Airport to catch my flight to San Diego the next morning.

Since the cancellation happened more than 14 days before departure, I know I’m not entitled to financial compensation (EU Regulation 261/2004). But am I entitled to reimbursement for a hotel night in Amsterdam?

I mean, you could have refused the offer and been fully refunded. It’s also possible there were several alternative options.

In real life, airlines do everything they can to avoid respecting passengers' rights, hoping they won’t be too procedural.

It works with a Tatra, but it breaks with an ElviajeroPar.

After all, they’d be foolish not to take advantage, since there are way more Tatras than ElviajeroPars.

I don’t feel like arguing with you. You can send whatever formal notices you want, take whoever you want to court, do whatever you want. The last airline that pulled this was TK. It was a Budapest-Tokyo Narita flight. They offered me departures from Vienna or Zagreb, date changes, or even a flight to Haneda instead. All of that with no fees, no lawsuits, and if I wanted, I could cancel. I ended up changing things to my advantage—flights that were initially really expensive. And I eventually canceled everything because I needed to stay in Hungary for personal reasons that don’t concern you. At some point, you’ve got to be pragmatic. Drop the principles—they’ll cave eventually. 😏

Merci Attila pour ta remarque. Je viens d'avoir une réponse négative de KLM suite à ma procédure en ligne. Je relancerai KLM via une lettre recommandée, après mon voyage, et si leur réponse est toujours négative je saisirai le médiateur tourisme et voyage. Ce n'est pas tant pour la somme en jeu mais il me semble être dans mon bon droit par rapport à la règlementation en vigueur.

En droit, ce que dit Attila est vrai. Mais la vraie vie est rarement alignée sur la normativité juridique, et, heureusement, dirais-je. Ce serait invivable. Donc, vous pouvez essayer d'obtenir quelque chose de KLM, vous êtes techniquement dans votre droit ; dans mon esprit réserver longtemps à l'avance suppose aussi d'assumer ce genre de truc, en voyant l'essentiel. C'est ce que j'ai toujours fait.
